RELATING TO LAND. Authorizes the issuance of general obligation bonds for the purchase of the real property located at 64-486 Kamehameha Highway on the North Shore of Oahu.

RELATING TO LIABILITY. Specifies that the State or a county that repairs or maintains a street of which the ownership or jurisdiction is in dispute between the State and county, shall be immune from liability for personal injuries or property damage arising out of the repair or maintenance of that street. Deems that maintenance of a street shall not confer ownership or jurisdiction over such street if the ownership or jurisdiction over the street is in dispute between the State and the county.

RELATING TO ABOLITION OF JOINT AND SEVERAL LIABILITY FOR GOVERNMENT ENTITIES IN HIGHWAY-RELATED CIVIL ACTIONS. Amends sections 663-10.5 and 663-10.9, HRS, to abolish joint and several liability for government entities in claims and cases relating to the maintenance and design of highways under chapter 663, HRS, so that government entities would be liable only for the percentage share of the damages actually attributable to them.

MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF TRANSPORTATION. Makes an emergency appropriation out of the State Highway Fund to provide funds for fiscal year 2024-2025 for the Department of Transportation to enforce the Motor Carrier Law.

RELATING TO TRANSPORTATION. Specifies that an engineering study is not required to be considered when reducing the maximum speed limit within ten miles per hour of the current speed limit for that road.

RELATING TO SPECIAL FACILITY REVENUE BONDS. Amends section 266-52, HRS, to increase the total principal amount of special facility revenue bonds that may be issued by the Department of Transportation for harbor improvements.

RELATING TO TRANSPORTATION. Increases the maximum value of capital advancement contracts that may be executed by the Department of Transportation without legislative approval. Repeals the requirement for the Department of Transportation to obtain legislative approval through concurrent resolution for capital advancement contracts greater than $2,000,000. Increases the total aggregate value of capital advancement contracts that the Department of Transportation may enter into in a fiscal year. Establishes certain reporting requirements related to capital advancement contracts.

RELATING TO CAPITAL ADVANCEMENT CONTRACTS. Amends section 266-19.5(d), HRS, for the purpose of increasing the cap for the contract value of any one capital advancement contract (CAC) and the cap for the total aggregate value of CACs in a fiscal year entered into by the Department of Transportation with private parties for harbor improvements. Adds reporting requirements for the department.

RELATING TO MOTOR CARRIERS. Exempts non-profit community-based organizations providing transportation services from motor carrier regulations under certain circumstances.

RELATING TO WATER CARRIERS. Establishes a Water Carrier Inflationary Cost Index Mechanism. Authorizes the Public Utilities Commission to grant exemptions to any water carrier from any requirement under the Hawaii Water Carrier Act. Defines "automatic adjustment mechanism".

RELATING TO TRANSPORTATION. Prohibits the operation of an electric bicycle on highway, street, roadway, or any other areas designated for motor vehicles. Prohibit unsafe operation of an electric bicycle. Prohibits the removal of a manufacturer- or factory-installed speed limiting device from an electric bicycle. Requires the department of transportation to develop a traffic safety education program and a public awareness campaign. Appropriate funds.

RELATING TO ELECTRIC BICYCLES. Amends the definition of electric bicycles subject to various state laws and classifies electric bicycles by top assisted speed. Establishes additional regulations for the registration and use of electric bicycles. Increases the minimum age to operate an electric bicycle.

RELATING TO TRANSPORTATION. Requires all bicycles equipped with motors to be operated only with all wheels on the ground at all times, with certain exceptions. Prohibits certain actions while operating a bicycle equipped with a motor. Defines "electric bicycle" in place of "low-speed electric bicycle". Defines "electric micro mobility device" and requires the same regulations as electric foot scooters to apply to electric micro mobility devices. Authorizes a person to ride an electric bicycle on a sidewalk at a speed not exceeding ten miles per hour. Prohibits a person from operating a bicycle or electric foot scooter under the age of eighteen without a helmet. Repeals the requirement that moped drivers use bicycle lanes. Substitutes the word "motor drive cycle" with the word "motor scooter". Appropriates funds for a coordinated education campaign on electric mobility devices.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
