RELATING TO A COMPENSATORY TIME CASH-OUT PILOT PROGRAM.

Establishes a Compensatory Time Cash-Out Pilot Program for eligible employees of the Department of Corrections and Rehabilitation who work in any state correctional facility.  Appropriates funds.

RELATING TO DEFERRED RETIREMENT FOR POLICE.

Establishes a deferred retirement option program to allow qualified officers who are eligible for retirement to continue working.

RELATING TO RECORDINGS OF LAW ENFORCEMENT ACTIVITIES.

Establishes the right of a person to record law enforcement activities.  Establishes a private right of action for any violation of the right to record law enforcement activities.

RELATING TO FIREWORKS.

Appropriates funds for the Honolulu Police Department and Department of Law Enforcement to conduct sting operations on Oahu to enforce fireworks ordinances or laws.  Authorizes a court to order the forfeiture of one-half of any pension of an Employees' Retirement System member, former member, or retirant upon conviction of the individual for a felony related to certain uses of prohibited fireworks.

RELATING TO THE STATE FIRE MARSHAL.

Appropriates funds to supplement the salary of the State Fire Marshal.

RELATING TO WORKERS' COMPENSATION.

Establishes a payment rate of cost plus forty per cent for nonprescription drugs, over-the-counter drugs, or nonlegend drugs for workers' compensation purposes, subject to certain conditions.

RELATING TO WORKERS' COMPENSATION.

Authorizes an attending physician to request a functional capacity exam and refer an injured employee for the exam without first obtaining permission from the employee's employer.  Allows licensed occupational and physical therapists to be deemed qualified to perform functional capacity exams.

RELATING TO STATE GOVERNMENT.

Authorizes boards and commissions to make employment decisions related to its officers and employees without the approval of the head of the department to which the board or commission is administratively attached.

RELATING TO HEALTH INSURANCE.

Requires the health benefits plan or plans established by the Employer-Union Health Benefits Trust Fund board to meet or exceed the requirements of the Prepaid Health Care Act.

RELATING TO THE WAGE AND HOUR LAW.

Amends the definition of "employee" in Hawaii's wage and hour law by excluding individuals who are primarily engaged in the range production of livestock.

RELATING TO MEDICAL CANNABIS.

Prohibits an employer from discriminating against a person in hiring, termination, or any term or condition of employment based on the person's status as a medical cannabis registry card holder, under certain conditions.  Authorizes an employer to use a fit-for-duty test for medical cannabis qualifying patients in potentially dangerous occupations.  Exempts certain occupations.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
