RELATING TO CORRECTIONS. Restricts the use of restrictive housing in state-operated and state-contracted correctional facilities, with certain specified exceptions. Requires the Department of Corrections and Rehabilitation to develop written policies and procedures regarding restrictive housing by 7/1/2026. Requires the Hawaii Correctional System Oversight Commission to review certain housing placements. Requires the Department by 4/1/2026 to develop policies and procedures to review committed persons placed in restrictive housing and develop a plan for committed persons currently in restrictive housing. Requires a report to the Legislature and Hawaii Correctional System Oversight Commission. Effective 7/1/3000. (HD1)

RELATING TO EVICTION MEDIATION. Beginning 2/5/2026, extends the period for a notice of termination of a rental agreement from five business days to ten calendar days; requires landlords, or their agents, and tenants to engage in mediation and requires landlords and their agents to delay filing an action for summary possession if a tenant schedules; requires landlords or their agents to provide specific information in the ten-calendar-day notice to tenants; and requires mediation to take place within thirty days from the date that a mediation center makes contact with both the landlord, or the landlord's agent, and tenant. Requires the Judiciary to submit a report to the Legislature. Appropriates funds. Sunsets 2/4/2028, but preserves the extension of the period for a notice of termination of a rental agreement from five business days to ten calendar days. Effective 7/1/3000. (HD1)

RELATING TO EDUCATION. Adds two ex officio members that represent the Department of Education and the Board of Education to the School Facilities Authority Board. Effective 7/1/3000. (HD1)

RELATING TO THE EARLY LEARNING BOARD. Adds the Director of the Hawaii Head Start State Collaboration Office, or their designee, as an ex officio, non-voting member to the Early Learning Board. Requires the Early Learning Board to invite the President of the Head Start Association of Hawaii, or their designee, to serve as an ex officio, non-voting member of the Board. Requires the Early Learning Board to invite a representative of local providers of early childhood education and development services to serve as an ex officio, non-voting member if no voting member fulfills that role. Effective 7/1/3000. (HD1)

RELATING TO PARKING. Establishes a state reserved parking space enforcement fine for parking in parking spaces reserved for persons with disabilities or electric vehicles to be deposited into the Safe Routes to School Program Special Fund. Increases the fines for any person who parks a non-electric vehicle in a space designated and marked as reserved for electric vehicles. Effective 7/1/3000. (HD1)

RELATING TO TRANSPORTATION. Authorizes county police officers to enforce the Statewide Traffic Code on all public streets, roadways, and highways within the State. Effective 7/1/2050. (HD1)

RELATING TO TRANSPORTATION. Prohibits any vehicles from blocking marked crosswalks. Requires a person under arrest who refuses to submit to a breath, blood, or urine test to surrender their license to a law enforcement officer. Increases the duration of the suspension of a license when a person is arrested for driving under the influence and refuses to submit to a breath, blood, or urine test. Establishes requirements for the State Highway Safety and Modernization Council. Authorizes the State Highway Safety and Modernization Council to select potential areas for the Department of Transportation to install additional photo red light imaging detector systems. Authorizes the Department of Transportation to implement additional automated speed enforcement systems in school zones as designated by the Safe Routes to School Advisory Committee. Requires annual reports. Requires the Department of Transportation to collaborate with the courts before any expansion of the safety camera systems. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO THE DEPARTMENT OF LAW ENFORCEMENT. Establishes the Agricultural Enforcement Program within the Department of Law Enforcement. Establishes the Agricultural Enforcement Special Fund. Establishes positions. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO GOVERNMENT. Sets the retirement allowance for a member who first earns credited service as a judge after 6/30/2025, to 1.75 per cent of the judge's average final compensation for each year of credited service as a judge. Reduces the minimum number of years of credited service qualified Tier 2 Employees' Retirement System members must have to be eligible for vested benefit status for service retirement allowance purposes from ten years to five years. Increases employer contributions to offset the resulting liability. Effective 7/1/3000. (HD1)

RELATING TO FIREWORKS. Amends multiple definitions and penalties for fireworks offenses, including heightened penalties if another person suffers substantial bodily injury, serious bodily injury, or death as a result of the fireworks offenses. Establishes criminal offenses of general fireworks or articles pyrotechnic prohibitions in the first and second degree; sending or receiving fireworks or articles pyrotechnic by air delivery; distributing fireworks or articles pyrotechnic to non-permit holders; removal or extraction of pyrotechnic contents; consumer fireworks prohibitions; refusal to provide identification; and violating requirements of carrier. Establishes an adjudication system and procedures to process fireworks infractions. Appropriates funds. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
