Appropriates funds for the Judiciary for the fiscal biennium beginning 7/1/2025, and ending 6/30/2027.  Effective 7/1/2025.

Increases the amount each juror or prospective juror is paid for each day of actual attendance at court.  Appropriates moneys.

Increases the rate of compensation and maximum allowable amounts per case for court-appointed counsel in criminal proceedings.  Appropriates moneys.

Establishes the amount of compensation for private-sector examiners who evaluate a criminal defendant's penal responsibility or fitness to proceed in a legal case.  Appropriates moneys.

Authorizes the Judiciary to determine the format of the juror qualification form and the means of its delivery and return.  Removes the requirement that the form be mailed.

Establishes positions and appropriates funds for Adult Services Probation of the First Circuit Court.

RELATING TO EXPUNGEMENT.

Makes an amendment to the Department of the Attorney General pilot project for a state-initiated expungement process of arrest records concerning promoting a detrimental drug in the third degree to include the possession of any schedule V substance in any amount.

RELATING TO EXPUNGEMENT.

Authorizes the Hawaii Criminal Justice Data Center to transmit all expungement orders to the Judiciary to effectuate the purposes of Act 159, SLH 2023.

RELATING TO THE JUDICIARY'S ‘ŌLELO HAWAI‘I INITIATIVES.

Appropriates funds to support the Olelo Hawaii Initiatives.

RELATING TO REDRESS FOR WRONGFUL CONVICTION AND IMPRISONMENT.

Requires the State to provide written notice to certain persons regarding the ability to file a claim for redress under applicable wrongful conviction law.  Requires the liberal construction of that law.  Provides for advance compensation for petitioners under certain circumstances.  Requires reports to Legislature from the Department of the Attorney General.

Status

RELATING TO THE WOMEN'S COURT.

Establishes a temporary three-year woman's court pilot program within the second, third, and fifth circuits.  Establishes temporary positions.  Requires a report.  Appropriates funds.  Sunsets 6/30/2028.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
