RELATING TO MOTOR VEHICLES. Increases penalties for a third or subsequent offense within five years of excessive speeding to a misdemeanor. Increases penalties for a second offense within five years of excessive speeding. Authorizes the court, as part of the person's sentencing for the third or subsequent offense, to order that the vehicle used by the person in the commission of the offense be subject to forfeiture. Requires individuals convicted of excessive speeding to be subject to identification processing procedures. Effective 7/1/3000. (SD1)

RELATING TO CONDOMINIUM. Requires budget summaries to contain all required information without referring the reader to other portions of the budget. Clarifies the ability to enforce compliance with budget summary and replacement reserves requirements and provides that an association has the burden of proving compliance. Effective 7/1/3000. (SD1)

RELATING TO CHILD ABUSE. Amends the definition of "child abuse or neglect" to clarify that the failure to provide certain needs to a child shall not constitute child abuse or neglect if the sole reason the person responsible for the care of the child is unable to adequately provide for the child's care is lack of financial resources; and evidence of parental request for support shall not be deemed as evidence of child abuse and neglect. Effective 7/1/3000. (SD1)

RELATING TO SUPPORTED DECISION-MAKING AGREEMENTS. Allows qualified adults, including adults with a disability, mentally ill adults, and adults sixty-five years of age or older, to enter into supported decision-making agreements with one or more members of a supportive community. Specifies the terms of a supported decision-making agreement, including access to personal information, agreement requirements, and circumstances for termination. Effective 7/1/3000. (SD1)

RELATING TO COVERED OFFENDER REGISTRATION. Amends the offense of sexual assault in the fourth degree to exclude a person who knowingly engages in or causes sexual contact with a minor who is at least sixteen years old and the person is contemporaneously acting in a professional capacity to instruct, advise, or supervise the minor, if the person is younger than twenty-four years of age at the time of the offense. Amends covered offender registration laws by expanding the definition of "sexual offense" to include additional sexual offenses from the Penal Code. Provides that the exception to covered offender registry public access requirements for a first-time misdemeanor offense does not apply when the covered offense was committed against a minor. Clarifies that a person who is required to report their location of residence in person every year under the covered offender registration requirements shall report during the thirty-day period following the offender's birthday, rather than from the offender's actual date of birth. Specifies how certain covered offenses are to be tiered for purposes of seeking termination of registration requirements. Effective 7/1/3000. (SD1)

RELATING TO LOBBYING. Establishes certain presumptions regarding lobbying on behalf of private clients. Makes certain contracts voidable when entered into in violation of the state lobbying law under certain conditions. Expands the definition of "lobbying" in the state lobbying law to include certain communications with certain government officials regarding procurement decisions. Effective 1/1/2027. (SD1)

RELATING TO DIGITAL IDENTIFICATION. Allows digitized identification cards to be accepted as a valid form of identification, under certain conditions. Authorizes state and county law enforcement agencies to accept a digitized identification card as proof of a person's identity beginning 7/1/2027. Effective 7/1/2077. (SD1)

RELATING TO DECLARATION OF WATER SHORTAGE AND EMERGENCY. Amends the conditions, manner, and areas in which the Commission on Water Resource Management can declare and provide notice of water shortages and emergencies. Limits the duration of a water shortage declaration to ninety days. Limits water usage restrictions imposed on a permittee or owner and operator to twenty per cent of the permittee's or owner and operator's last reported monthly use. Requires CWRM to maintain a list of names and postal or email addresses of persons who request notification of a water shortage declaration and send them a copy of a notice of a water shortage declaration whenever water shortage is declared. Effective 7/1/2040. (SD1)

RELATING TO PET INSURANCE. Establishes a regulatory framework specifically for pet insurance based on the National Association of Insurance Commissioners' Pet Insurance Model Act. Effective 7/1/2050. (SD1)

RELATING TO HIGHWAY SAFETY. Requires all skateboard users under the age of sixteen to wear a helmet while operating a skateboard. Takes effect 1/1/3000. (SD1)

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT. Clarifies that Act 130, SLH 2024, which amended the Hawaiian Homes Commission Act, takes effect on the earlier of the date of the Secretary of the Interior's notification letter that Act 130 does not require congressional approval, or on the date that the United States Congress approval becomes law. Effective 7/1/3000. (HD1)

RELATING TO FIREARMS REPORTING. Amends the annual reporting requirements imposed on the Department of the Attorney General and the chief of police of each county regarding licenses to carry firearms.

RELATING TO THE HAWAII CORRECTIONAL SYSTEM OVERSIGHT COMMISSION. Beginning July 1, 2025, extends the term of the Oversight Coordinator for the Hawaii Correctional System Oversight Commission. Authorizes the Hawaii Correctional System Commission to review the Coordinator's performance and make a recommendation to the Governor as to whether the Coordinator should be retained. Clarifies that the Oversight Coordinator has the general authority to inspect agencies and correctional facilities without notice. (SD1)

RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY. Clarifies the Hawaii Public Housing Authority’s powers relating to housing projects. Takes effect 7/1/2050. (SD1)

RELATING TO MOTORCYCLE INSTRUCTION PERMITS. Requires all applicants for a motorcycle instruction permit to successfully complete a basic motorcycle rider course approved by the Department of Transportation and Division of Motor Vehicle Registration of the Department of Customer Services of the City and County of Honolulu before becoming eligible for the permit. Clarifies that a person shall not operate a motor vehicle in connection with the driving training course without a valid temporary instruction permit unless it is a motorcycle that is being used for training purposes on an enclosed state certified training range. Effective 7/1/3000. (SD1)

RELATING TO TRANSPORTATION. Specifies that an engineering study is not required to be considered when reducing the maximum speed limit within ten miles per hour of the current speed limit for that road. Requires the Department of Transportation to use National Association of City Transportation Officials guidance when setting a maximum speed limit for sections of highways with residential or commercial areas or schools immediately on a highway. Effective 7/1/3000. (SD1)

RELATING TO AGRICULTURE. Extends the offense of false labeling of Hawaii-grown coffee to include roasted coffee. Effective 7/1/2050. (SD1)

RELATING TO PUBLIC LANDS. Requires the Board of Land and Natural Resources to lease public lands for recreation-residence use by public lottery and restrict participation in the public lottery to residents of the county in which the leased land is located. Effective 7/1/2040. (SD1)
