RELATING TO HISTORIC PRESERVATION. Amends the definition of "historic property" to require that the property meets the criteria for inclusion in the Hawaii Register of Historic Places or has important value to Native Hawaiians or other ethnic groups of the State due to associations with cultural practices once carried out, or still carried out, at the property or associations with traditional beliefs, events, or oral accounts that are important to history, traditional practices, and cultural identity.

RELATING TO MOTOR VEHICLES. Increases the penalty for a third or subsequent offense of excessive speeding to a class C felony. Authorizes the court, as part of the person's sentencing for the third or subsequent offense, to order that the vehicle used by the person in the commission of the offense be subject to forfeiture. Requires a repeat offender convicted of a class C felony for excessive speeding be fingerprinted. Effective 7/1/2050. (SD1)

RELATING TO DECLARATION OF WATER SHORTAGE AND EMERGENCY. Amends the conditions, manner, and areas in which the Commission on Water Resource Management can declare and provide notice of water shortages and emergencies.

RELATING TO CONDOMINIUM RESERVES. Excludes the good faith defense for associations whose boards adopt a budget that omits a detailed budget summary as required by section 514B-148, HRS. Clarifies a unit owner's standing and the association's burden of proving compliance. Effective 7/1/2050. (SD1)

RELATING TO PROPERTY DAMAGE OF CRITICAL INFRASTRUCTURE FACILITIES. Establishes the offense of criminal property damage to critical infrastructure facilities in the first and second degree. Adds commitment of the offense of criminal damage of critical infrastructure facilities that causes the death of another person to the offense of manslaughter. (SD1)

RELATING TO WATER POLLUTION. Requires a landowner in possession of ten thousand or more acres to be liable for damages and fines arising from runoff originating on the land and entering into state waters or onto state lands. Requires the Department of Health to adopt rules as necessary for the purposes of this provision. (SD1)

RELATING TO PARKING. Authorizes the counties to adopt ordinances to enforce the accessible parking space requirements for parking spaces reserved for persons with disabilities and electric vehicles.

RELATING TO THE WAGE AND HOUR LAW. Authorizes the Department of Labor and Industrial Relations to issue an order of wage payment violation to the employer found to be in violation of wage and hour provisions. Establishes penalties, enforcement, and appeal procedures. Amends the definition of "wage" to include compensation for labor or services rendered by an employee, whether the amount is determined on a time, task, piece, commission, or other basis of calculation.

RELATING TO MOTORCYCLE INSTRUCTION PERMITS. Starting on July 1, 2026, requires all applicants for a motorcycle instruction permit to successfully complete a basic motorcycle rider course approved by the Department of Transportation before becoming eligible for the permit. Designates exemptions for certain drivers on an enclosed training course. Effective 7/1/2050. (SD1)

RELATING TO CIVIL RIGHTS. Establishes that it is an unlawful discriminatory practice for places of public accommodation to deny a person with a disability full and equal enjoyment of information related to their services, facilities, privileges, advantages, or accommodations using information and communication technology intended for use by the general public as applicants, participants, customers, clients, or visitors. Establishes exceptions. Effective 12/31/2050. (SD1)

RELATING TO PUBLIC LANDS. Authorizes the Board of Land and Natural Resources to lease public lands for recreational-residential use by public lottery and restrict participation in the public lottery to residents of the county in which the leased land is located.

RELATING TO EMPLOYMENT. Requires employers in the hospitality industry to implement anti-harassment measures, provide training, and equip certain workers with panic buttons. Prohibits retaliation against a hospitality worker who files a complaint, uses the provided panic button, or participates in an investigation or proceeding related to a harassment complaint. Requires the Department of Labor and Industrial Relations to adopt rules, including rules determining penalties and establishing procedures for handling complaints. Requires all hospitality employers to comply no later than 1/1/2026. Effective 7/1/2050. (SD1)

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE. Prohibits a landlord or the landlord's agent from charging an application fee for a criminal background check or credit report if an applicant provides a certified copy of a criminal background check or credit report. Prohibits a landlord or the landlord's agent from charging an application fee if a comprehensive reusable tenant screening report is available. Requires a landlord or the landlord's agent to provide, upon request, a certified copy of an applicant's criminal background check or credit report. Effective 7/1/2050. (SD1)

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS. Allows a previously authorized or permitted commercial activity or operations to continue operation while the appropriate agency determines whether the activity or operation is subject to or exempt from the environmental review process when challenged. Allows a person with oversight of a previously authorized or permitted commercial activity to renew the appropriate permits while under the environmental review process. Effective 1/1/2050. (SD1)

RELATING TO MENTAL HEALTH. Clarifies and expands the circumstances and procedures available for emergency transportation, examination, and hospitalization under chapter 334. Provides limits on liability for state and local governments and professionals during mental health emergency procedures while performing their duties in the course of employment. Expands the notice requirements for an emergency hospitalization to include an individual's health care surrogate and clarifies when notice to family members can be waived. Removes the authority of the family court to appoint a legal guardian in a proceeding for involuntary hospitalization. Removes the requirement that psychiatric facilities wait for a response on a notice of intent to discharge an involuntary hospitalization patient prior to discharge. Clarifies the circumstances under which a subject of an order for assisted community treatment can be administered medication over the subject's objection. Provides limits on liability for an assisted community treatment provider. Modifies the administrative authorization of medical treatment over the patient's objection to be reviewed by a single decision-maker who is a psychiatrist. Effective 12/31/2050. (SD1)

RELATING TO MEDICAL RECORDS. Repeals the requirement for the Department of Health to approve a provider's arrangement for the retention and preservation of patients' medical records prior to ceasing operations. Clarifies that retention and preservation of medical records must be consistent with federal and state regulations. (SD1)
