RELATING TO THE TRANSITION OF THE OAHU REGIONAL HEALTH CARE SYSTEM FROM THE HAWAII HEALTH SYSTEMS CORPORATION INTO THE DEPARTMENT OF HEALTH. Repeals the requirement to transfer the Oahu Regional Health Care System from the Hawaii Health Systems Corporation to the Department of Health. Repeals certain changes to the Hawaii Revised Statutes that were made by Act 212, Session Laws of Hawaii 2021. Requires the Oahu Regional Health Care System and the Department of Health to enter into an agreement regarding the care of patients transferred from the Hawaii State Hospital to an appropriate Oahu Regional Health Care System facility, subject to certain conditions. Requires the Department of Health and Oahu Regional Health Care System to submit a report to the Legislature. (SD2)

RELATING TO THE DEPARTMENT OF HEALTH. Establishes maximum rates of payment for medical care for patients of the Hawaii State Hospital or of another psychiatric facility who are under the custody of the Director of Health. Authorizes the Department of Health to establish long-term care payment rates for patients discharged to a long-term care facility from the Hawaii State Hospital or another psychiatric facility where they were under the custody of the Director of Health. Exempts the Department of Health from chapter 103F, HRS, for the procurement of medical care and long-term care for patients who are or were under the custody of the Director of Health at the Hawaii State Hospital or a psychiatric facility. Effective 12/31/2050. (SD1)

RELATING TO MENTAL HEALTH. Clarifies and expands the circumstances and procedures available for emergency transportation, examination, and hospitalization under chapter 334. Provides limits on liability for state and local governments and professionals during mental health emergency procedures while performing their duties in the course of employment. Expands the notice requirements for an emergency hospitalization to include an individual's health care surrogate and clarifies when notice to family members can be waived. Removes the authority of the family court to appoint a legal guardian in a proceeding for involuntary hospitalization. Removes the requirement that psychiatric facilities wait for a response on a notice of intent to discharge an involuntary hospitalization patient prior to discharge. Clarifies the circumstances under which a subject of an order for assisted community treatment can be administered medication over the subject's objection. Provides limits on liability for an assisted community treatment provider. Modifies the administrative authorization of medical treatment over the patient's objection to be reviewed by a single decision-maker who is a psychiatrist. Effective 12/31/2050. (SD2)

RELATING TO NON-GENERAL FUNDS OF THE DEPARTMENT OF HEALTH. Repeals the requirement that a portion of the fees collected for certified copies of certain certificates issued by the Department of Health be deposited to the credit of the general fund. Repeals the Birth Defects Special Fund. Requires a portion of fees collected for marriage licenses to be deposited into the Vital Statistic Improvement Special Fund. (SD1)

RELATING TO HARM REDUCTION. Amends the distribution system of sterile needles and syringes under the Sterile Needle and Syringe Exchange Program from a one-to-one exchange system to a needs-based distribution system. Authorizes non-injection drug user participation in the Program. Modifies liability for Program participants, staff, and law enforcement officers. (SD2)

RELATING TO VIRAL HEPATITIS. Establishes and appropriates funds for a Hepatitis Prevention Program within the Department of Health. Repeals the authority given to the Department of Health to provide medications for the treatment of certain newborns. Repeals the no implied warranty provision for blood injections and transfusions with regard to the serum hepatitis virus. Establishes positions. Appropriates funds. Effective 12/31/2050. (SD1)

RELATING TO ADMINISTRATIVE ORDERS. Requires any order to cease and desist issued by the Director of Health that is administratively appealed to remain in effect during the appeals process.

RELATING TO MEDICAL RECORDS. Repeals the requirement for the Department of Health to approve a provider's arrangement for the retention and preservation of patients' medical records prior to ceasing operations. Clarifies that retention and preservation of medical records must be consistent with federal and state regulations. (SD1)

RELATING TO MENTAL HEALTH. Establishes and appropriates moneys for a Mental Health Emerging Therapies Special Fund, to be administered by the Department of Health. Requires annual reports to the Legislature. Effective 12/31/2050. (SD1)

RELATING TO UNIVERSAL IMMUNIZATION FUNDING PROGRAM. Establishes the Universal Immunization Funding Program for the purpose of administering immunizations to individuals in the State who are not eligible to receive immunizations at no cost through other programs. Establishes the Universal Immunization Purchase Special Fund into which fees will be deposited to finance the Universal Immunization Funding Program. Effective 12/31/2050. (SD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
