RELATING TO THE GENERAL FUND. Provides a tax credit to taxpayers and makes deposits to the emergency and budget reserve fund and other post-employment benefits trust fund pursuant to article VII, section 6, of the Hawaii State Constitution. Appropriates funds. Effective 7/1/2050. (SD1)

RELATING TO REVOLVING FUNDS. Requires the Legislature, in establishing or reviewing a revolving fund, to ensure the revolving fund is financially self-sustainable by either annual projections that show that the revolving fund will be sustainable without appropriations of general funds or a schedule of projected collections of outstanding payments to the revolving fund. Effective 7/1/2050. (SD1)

RELATING TO CONFORMITY TO THE INTERNAL REVENUE CODE. Conforms Hawaii income and estate and generation-skipping transfer tax laws to the Internal Revenue Code of 1986, as amended as of December 31, 2024.

RELATING TO PASS-THROUGH ENTITY TAXATION. For taxable years beginning after 12/31/2024, requires all qualified members claiming a credit for pass-through entity taxation to adjust their income to include the qualified member's share of taxes paid by an electing pass-through entity. Effective July 1, 2050.

RELATING TO THE EARNED INCOME TAX CREDIT. Clarifies that nonresidents who claim the refundable earned income tax credit are required to adjust the amount claimed using the ratio of their Hawaii adjusted gross income to federal adjusted gross income. Eliminates the unlimited carryforward on nonrefundable earned income tax credits for tax year 2022.

RELATING TO INCOME TAX WITHHOLDING. For taxable years beginning after December 31, 2024, (1) repeals the maximum tax rate that may be considered in determining the amount of income tax that must be withheld and the requirement that a standard deduction allowance be treated as if it was denominated as a withholding exemption, and (2) for the purpose of income tax withholding, permits the Director of Taxation to prescribe a standard deduction allowance in an amount more or less than one whole exemption.

RELATING TO SMALL PURCHASES. Increases the minimum amount for purchases constituting small purchase procurements not subject to an electronic system from $25,000 to $50,000. Requires a report to the Legislature. (SD2)

RELATING TO THE HAWAII SYMPHONY ORCHESTRA. Designates the Hawaii Symphony Orchestra as the State of Hawaii Symphony Orchestra. Exempts general fund appropriations to the State of Hawaii Symphony Orchestra from the requirements of chapter 42F, Hawaii Revised Statutes. Requires annual reports to the Legislature. Appropriates funds for general operating costs of the Orchestra and for deposit into the State of Hawaii Endowment Fund. Effective 7/1/3000. (HD1)

Establishes and implements evidence-based performance metrics for the P-20 Partnerships for Education to allow better evidence-based assessments of the P-20 Partnerships for Education advisory council's workforce and pathway development programs. RELATING TO THE DRUG AND ALCOHOL TOXICOLOGY TESTING LABORATORY. Extends the lapse date for funds appropriated out of the Drug and Alcohol Toxicology Testing Laboratory Special Fund for fiscal years 2023-2024 and 2024-2025 for the establishment and maintenance of a drug and alcohol toxicology testing laboratory. RELATING TO TRANSPORTATION. Requires the Department of Transportation to conduct a feasibility study on implementing a clean fuel standard for alternative fuels in the State. Requires, no later than 1/1/2028, the Department of Transportation to adopt rules governing a clean fuel standard for alternative fuels in the State. Effective 7/1/3000. (HD1)

RELATING TO WATER CARRIERS. Authorizes the Public Utilities Commission to establish, no later than 7/1/2026, a Water Carrier Inflationary Cost Index automatic adjustment mechanism and waive or exempt any water carrier from any requirement under the Hawaii Water Carrier Act. RELATING TO TRANSPORTATION. Prohibits a person from operating a moped or electric motorcycle in certain areas for bicycles. Renames the Electric Bicycle and Electric Moped Rebate Program to the Electric Mobility Device Rebate Program. Expands eligibility and amends the maximum rebate amounts. Reduces the deadline to submit an application to six months from the date of purchase. Authorizes the Administrator of the rebate program to authorize grants under certain circumstances. Requires applicants who are enrolled in a school, community, college, or university to demonstrate a financial need to be eligible for an additional assistance rebate. Exempts certain class 3 electric bicycles from registration requirements. Establishes a cap for the Electric Mobility Device Subaccount and requirements for transferring funds into the Subaccount. Amends the age requirement for required helmet use from 16 to 18 years of age. Prohibits a person under the age of fifteen from operating a class 3 electric bicycle. Establishes rules for electric bicycle operation. Allows use of electric bicycles on public sidewalks, subject to certain conditions. Prohibits individuals under 18 years of age from operating an electric motorcycle or motor-driven cycle. Changes the term "motor scooter" to "motor-driven vehicle". Appropriates funds. Effective 7/1/2050. (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
