Status

RELATING TO WATER POLLUTION.

Requires a landowner in possession of ten thousand or more acres to be liable for damages and fines arising from runoff originating on the land and entering into state waters or onto state lands.  Requires the Department of Health to adopt rules as necessary for the purposes of this provision.  Effective 4/23/2057.  (SD2)

Status

RELATING TO UNDERGROUND STORAGE TANKS.

Clarifies the level of environmental restoration that owners and operators of underground storage tanks or tank systems must satisfy in the event of a confirmed release of jet fuel from an underground storage tank or tank system.  Establishes that the environmental restoration shall require the cleanup and removal of jet fuel, including jet fuel additives and compounds resulting from the degradation of jet fuel or jet fuel additives, or the reaction of jet fuel or jet fuel additives with water or other chemicals, as soon as practicable, with the goal of complete removal.  Establishes a rebuttable presumption that any detection of these contaminants in the vicinity of an underground storage tank or a tank system after a confirmed release is a result of the confirmed release.  Effective 12/31/2050.  (SD1)

Status

RELATING TO WASTEWATER MANAGEMENT.

Clarifies that the prohibition against discharging wastewater or raw sewage into state waters after 12/31/2026 applies to treatment plants.  Effective 12/31/2050.  (SD2)

Status

RELATING TO WASTE DISPOSAL FACILITIES.

Prohibits the construction, modification, or expansion of any waste or disposal facility for hazardous waste or solid waste on land that is near or above a significant aquifer as determined by the Department of Health, in consultation with the Commission on Water Resource Management.  Prohibits waste or disposal facility on class A and B agricultural land.  Clarifies buffer zones; Prohibits the use of fly ash, bottom ash, or a combination of fly ash and bottom ash from a municipal waste combustor, including any ash residue that remains after removal of metals for recycling into new metal products, for the purposes of road building, construction, or as alternative daily cover material on a landfill.  Requires fly ash, bottom ash, or a combination of fly ash and bottom ash from a municipal waste combustor to be disposed of in a double-lined and duly licensed municipal solid waste or hazardous waste landfill.  Effective 12/31/2050.  (SD2)

Status

RELATING TO STATE FUNDS.

Allocates interest earned on balances within the emergency and budget reserve fund to the general fund in years in which the emergency and budget reserve fund's balance exceeds the State's fund balance objective.  For any fiscal year following a fiscal year in which emergency and budget reserve fund interest is deposited into the general fund, requires the Governor to include in the budget or supplemental budget submitted to the Legislature a request that an amount of general funds equal to the amount of interest deposited be expended to advance projects that address climate change impacts.  Effective 7/1/2050.  (SD2)

Status

RELATING TO ECONOMIC DEVELOPMENT.

Beginning 1/1/2026, increases the Transient Accommodation Tax by an unspecified amount.  Requires the Governor to request in the budget or supplemental budget submitted to the Legislature for an amount of general funds equal to an unspecified percentage of the transient accommodations tax revenue be expended to advance specific projects that address climate change and support tourism marketing and destination management.  Effective 7/1/2050.  (SD3)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
