Madame:

 

     Your Committee on Health, to which was referred S.B. No. 1447 entitled:

 

"A BILL FOR AN ACT RELATING TO ADMINISTRATIVE ORDERS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require any cease and desist order issued by the Director of Health that is administratively appealed to remain in effect during the appeals process.

 

     Your Committee received testimony in support of this measure from the Department of Health.

 

     Your Committee finds that existing law authorizes the Director of Health to issues cease and desist orders to certain state-licensed facilities due to concerns regarding patient health and safety.  Your Committee further finds that to ensure the personal safety of patients at these facilities, it is necessary to clarify that these cease and desist orders remain in place during the administrative appeal process, which may take weeks or months.

 

     As affirmed by the record of votes of the members of your Committee on Health that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1447 and recommends that it pass Second Reading and be referred to your Committee on Judiciary & Hawaiian Affairs.
