Sir:

 

     Your Committee on Judiciary, to which was referred S.B. No. 1408, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE HAWAIIAN HOMES COMMISSION ACT,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to clarify that Act 130, Session Laws of Hawaii 2024, shall take effect on either the date of the Secretary of the Interior's notification letter to the Congressional Committee Chairpersons that this Act meets none of the criteria in title 43 Code of Federal Regulations section 48.20, or on the date that the United States Congress approval becomes law.

 

     Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands.

 

     Your Committee received comments on this measure from one individual.

 

     Your Committee finds that any measure amending the Hawaiian Homes Commission Act, 1920, as amended, requires the approval of the United States Congress or confirmation provided by the Secretary of the Interior that the measure does not meet certain criteria established by federal law.  This measure addresses this requirement by clarifying that an act increasing the loan limit for direct loans provided by the Department of Hawaiian Home Lands shall be effective when the proper approval process has been completed. 

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1408, S.D. 1, and recommends that it pass Third Reading.
