Madame:

 

     Your Committee on Transportation, to which was referred H.B. No. 810 entitled:

 

"A BILL FOR AN ACT RELATING TO NOISE POLLUTION,"

 

begs leave to report as follows:

 

     The purpose of this measure is to establish a private right of action for any person aggrieved by a violation of the Federal Aviation Act and existing federal laws to bring a civil action against the owner or operator of the helicopter in violation and collect damages and litigation costs.

 

     Your Committee received testimony in opposition to this measure from Vertical Aviation International.  Your Committee received comments on this measure from the Department of Transportation.  

 

     Your Committee finds that there have been community complaints alleging that helicopter tour operators are flying too close to residences.  Your Committee further finds that operators are alleged to operate at varying hours of the day and that the noise generated from their operations causes significant disruption to many residents on a daily basis.  This measure provides a mechanism for persons to hold disruptive operators accountable by establishing a private right of action for any person aggrieved by violations of federal aviation law.

 

     Your Committee has amended this measure by changing the effective date to July 1, 3000, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 810, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 810, H.D. 1, and be referred to your Committee on Energy & Environmental Protection.
