Madame:

 

     Your Committee on Water & Land, to which was referred H.B. No. 511 entitled:

 

"A BILL FOR AN ACT RELATING TO PUBLIC LANDS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to provide that a survey of the land that is to be set aside shall not be a condition precedent to the setting aside of public lands to any department or agency of the State.  

 

     Your Committee received testimony in support of this measure from the Department of Land and Natural Resources; Hawaii Cattlemen's Council, Inc.; Boteilho Hawaii Enterprises Inc.; SC Ranch Co. Inc.; TiLeaf Group; and one individual.

 

     Your Committee finds that requiring land surveys before setting aside public lands between state departments causes unnecessary delays and administrative burdens, hinders efficient land use, and increases costs.  This measure eliminates the survey requirement as a condition precedent, streamlining the process to expedite land transfers, such as pending transfers pursuant to Act 90, Session Laws of Hawaii 2003, and helps conserve government resources.

 

     Your Committee has amended this measure by changing the effective date to July 1, 3000, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 511, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 511, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
