STAND. COM. REP. NO.  153

Honolulu, Hawaii

                , 2025

RE:   H.B. No. 450

      H.D. 1

Honorable Nadine K. Nakamura

Speaker, House of Representatives

Thirty-Third State Legislature

Regular Session of 2025

State of Hawaii

Madame:

Your Committee on Culture & Arts, to which was referred H.B. No. 450 entitled:

"A BILL FOR AN ACT RELATING TO THE DEPARTMENT OF BUSINESS, ECONOMIC DEVELOPMENT, AND TOURISM,"

begs leave to report as follows:

The purpose of this measure is to:

     (1)  Transfer the duties and responsibilities of the Department of Accounting and General Services relating to the State Foundation on Culture and the Arts and King Kamehameha Celebration Commission to the Department of Business, Economic Development, and Tourism; and

     (2)  Transfer the authority held by the Comptroller over the Works of Art Special Fund to the Director of Business, Economic Development, and Tourism.

Your Committee received testimony in support of this measure from the Department of Business, Economic Development, and Tourism; and one individual.  Your Committee received comments on this measure from the Department of Accounting and General Services and State Foundation on Culture and the Arts.

Your Committee finds that the mission and duties of the State Foundation on Culture and the Arts and King Kamehameha Celebration Commission align more closely with those of the Department of Business, Economic Development, and Tourism.  Your Committee further finds that transferring these duties and responsibilities, along with expending authority and responsibilities relating to the Works of Art Special Fund, to the Department of Business, Economic Development, and Tourism ensures more appropriate management and support of these organizations.

Your Committee has amended this measure by:

     (1)  Appropriating funds to the Department of Business, Economic Development, and Tourism for one full-time equivalent position within the Administrative Services Office to assist with the transfer;

     (2)  Changing the effective date to an unspecified year, with the goal of providing two years to complete the transfers pursuant to this measure; and

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

As affirmed by the record of votes of the members of your Committee on Culture & Arts that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 450, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 450, H.D. 1, and be referred to your Committee on Economic Development & Technology.

Respectfully submitted on behalf of the members of the Committee on Culture & Arts,
