Madame:

 

     Your Committee on Transportation, to which was referred H.B. No. 1464 entitled:

 

"A BILL FOR AN ACT RELATING TO AUTOMOTIVE REPAIR,"

 

begs leave to report as follows:

 

     The purpose of this measure is to provide access by owners of motor vehicles and independent repair facilities to motor vehicle manufacturer diagnostic and repair information and diagnostic repair tools otherwise made available to dealers.

 

     Your Committee received testimony in support of this measure from O'Reilly Auto Parts; Autocare Association; 808 Safety; Coalition for Automotive Repair Equality; LKQ Corporation; and two individuals.  Your Committee received testimony in opposition to this measure from the Alliance for Automotive Innovation and Hawaiʻi Automobile Dealers Association.  Your Committee received comments on this measure from the Motorcycle Industry Council.

 

     Your Committee finds that this measure allows vehicle owners and independent repair shops to have the same critical repair and maintenance data as motor vehicle dealers.  This will allow vehicle owners to choose where to have their vehicle repaired and may lead to more affordable repairs.

 

     Your Committee respectfully requests that a possible exemption for motorcycles be considered as this measure moves through the legislative process.

 

     Your Committee has amended this measure by:

 

     (1)  Deleting language that would have established various requirements for manufacturers of vehicles sold in the State, except for manufacturers of model year 2022 or later vehicles;

 

     (2)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1464, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1464, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
