Madame:

 

     Your Committee on Transportation, to which was referred H.B. No. 1165 entitled:

 

"A BILL FOR AN ACT RELATING TO HIGHWAYS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to authorize the counties to sell or dispose of property bordering the ocean when the Department of Transportation requests the acquisition of the property for state highway purposes.

 

     Your Committee received testimony in support of this measure from the Department of Transportation.

 

Your Committee finds that this measure will provide a narrow exception to the prohibition on counties selling property that is bordering the ocean if it is for state highway purposes, such as for construction, maintenance, or realignment of state highways.

 

     Your Committee has amended this measure by:

 

     (1)  Updating the severability clause;

 

     (2)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (3)  Making a technical, nonsubstantive amendment for clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1165, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1165, H.D. 1, and be referred to your Committee on Water & Land.
