Establishes that if a state legislative vacancy occurs due to the death or permanent incapacitation of the prior incumbent before a primary election, but after the close of filing for that election, and the prior incumbent was the only person whose name appeared on any ballot for that seat for that election, the Governor's appointment of a replacement shall be valid for both the unexpired term and the next succeeding term.  Effective 1/1/2525.  (SD1)

RELATING TO VEGETATION MANAGEMENT NEAR UTILITY LINES.

Requires the Department of Land and Natural Resources to create and annually update a wildfire hazard map.  Requires private and public property owners to trim grasses within certain proximities of public rights of way and utility lines, enforced by the State Fire Marshal as to State-owned land and the applicable county fire department as to privately owned land.  Authorizes electric utility companies to enter private or public property to trim or remove hazardous vegetation.  Appropriates funds.  Effective 6/1/2050.  (SD2)

RELATING TO HISTORIC PRESERVATION.

Amends the definition of "historic property" to require that the property meets the criteria for inclusion in the Hawaii Register of Historic Places or has important value to Native Hawaiians or other ethnic groups of the State due to associations with cultural practices once carried out, or still carried out, at the property or associations with traditional beliefs, events, or oral accounts that are important to history, traditional practices, and cultural identity.  (SD1)

RELATING TO WATER CARRIERS.

Authorizes the Public Utilities Commission to establish a Water Carrier Inflationary Cost Index Automatic Adjustment Mechanism to address, among other things, inflation and regulatory lag.  Authorizes the Public Utilities Commission to grant exemptions to any water carrier from any requirement under the Hawaii Water Carrier Act.  Defines "automatic adjustment mechanism".  Effective 7/1/2050.  (SD2)

RELATING TO HISTORIC PRESERVATION REVIEWS.

Requires the Department of Land and Natural Resources to determine the effect of any certain proposed housing projects within ninety days of a request for determination.  Establishes historical review requirements based on the project area's known historic, cultural, and archaeological resources.  Establishes procedures and notification requirements if previously unidentified human remains or previously unidentified historic or cultural resources are discovered.  (SD1)

RELATING TO HOTELS.

Requires hotelkeepers to provide adequate notice of service disruptions to third-party vendors and prospective and current guests under certain conditions.  Prohibits hotelkeepers from imposing any fee, penalty, or other charge and from retaining any deposit of a guest who cancels a reservation if a service disruption is likely to exist during the period of the reservation.  Requires any hotelkeeper that violates or causes another person to violate this Act to forfeit to the injured party three times the amount of the sum charged in excess of what the hotelkeeper is entitled to.  Effective 7/1/2050.  (SD2)

Authorizes the payment of allowances for TRICARE, TRICARE Dental Program, and vision coverage to all officers, warrant officers, and enlisted personnel of the Hawaii National Guard ordered to active duty for more than 30 days.

RELATING TO MOTOR VEHICLES.

Increases the penalty for a third or subsequent offense of excessive speeding to a class C felony.  Authorizes the court, as part of the person's sentencing for the third or subsequent offense, to order that the vehicle used by the person in the commission of the offense be subject to forfeiture.  Requires a repeat offender convicted of a class C felony for excessive speeding be subject to identification processing, including fingerprinting and photographing.  Effective 7/1/2050.  (SD2)

RELATING TO ELECTRIC VEHICLE BATTERIES.

Establishes a two-year Electric Vehicle Battery Recycling and Reuse Working Group within the Hawaii State Energy Office.  Requires the working group to examine how to maximize the recycling and reuse of electric vehicle batteries and recommend electric vehicle battery management practices.  Requires a report to the Legislature.  (SD1)

RELATING TO CORRECTIONS.

Restricts the use of restrictive housing in state-operated and state-contracted correctional facilities, with certain specified exceptions.  Requires the Department of Corrections and Rehabilitation to develop written policies and procedures regarding restrictive housing by 7/1/2026.  Requires the Hawaii Correctional System Oversight Commission to review certain housing placements.  Requires the Department to develop policies and procedures to review committed persons placed in restrictive housing and develop a plan for committed persons currently in restrictive housing by 4/1/2026.  Requires a report to the Legislature and Hawaii Correctional System Oversight Commission.  Effective 7/1/2077.  (SD2)

RELATING TO PEDESTRIANS.

Authorizes pedestrians to act contrary to the statewide traffic code when a reasonably careful pedestrian would determine that there is no immediate danger of a collision with a moving vehicle if the pedestrian is more than 200 feet from a crosswalk.  Requires a driver of a vehicle to yield to a pedestrian when the pedestrian clearly indicates their intention to cross a roadway within a crosswalk.  Effective 7/1/2050.  (SD1)

RELATING TO DISCRIMINATION.

Establishes provisions relating to civil remedies for discriminatory reporting to a law enforcement officer.  Provides that any person who contacts a law enforcement officer to contact a person on the basis of the person's actual or perceived race, color, ancestry, ethnicity, national origin, place of birth, sex, age, religion, disability, sexual orientation, or gender identity with the specific intent to infringe upon the person's certain rights shall be civilly liable for resulting damages.  Requires the Department of Law Enforcement, in consultation with the Hawaii Civil Rights Commission, to provide guidance to the public on the enactment of this Act.  Effective 9/1/2025.  (SD2)

PROPOSING AN AMENDMENT TO ARTICLE VI, SECTION 3, OF THE HAWAII STATE CONSTITUTION TO ALLOW THE SENATE MORE TIME TO CONFIRM JUDICIAL APPOINTMENTS.

Proposes an amendment to the Hawaii State Constitution to extend the amount of time allowed the Senate to consider and act on the appointments of justices and judges from thirty to sixty days for appointments made between April 1 and December 31 when the Senate is not in Regular Session or is about to adjourn the Regular Session.

PROPOSING AMENDMENTS TO ARTICLE IV, SECTIONS 4 AND 6, OF THE HAWAII STATE CONSTITUTION REGARDING REAPPORTIONMENT.

Proposes a constitutional amendment to specify that reapportionment shall be based on the resident population, as counted in the decennial United States census for the respective reapportionment year, rather than the permanent resident population.  (SD1)

RELATING TO STATE ENTERPRISE ZONES.

Amends the definition of "eligible business activity" for Enterprise Zone Program purposes to include retail sales of tangible personal property manufactured and sold in the enterprise zone that is to be used or consumed by the purchaser and not for resale, the processing of value-added agricultural products grown within an enterprise zone, and the provision of professional services by health care professionals in health-care related sectors.  Extends the eligibility period of the state business tax credit and general excise tax exemption for qualified businesses within state Enterprise Zones from 7 years to 9 years.  Extends the eligibility period of the general excise tax exemption for qualified businesses within state Enterprise Zones engaged in the manufacturing of tangible personal property or the producing or processing of agricultural products from 10 years to 12 years.  Makes the extension of the state business tax credit eligibility period applicable to taxable years beginning after 12/31/2025.  Makes the extension of the general excise tax exemption eligibility period take effect on 1/1/2027.  Effective 7/1/2050.  (SD2)

RELATING TO ELECTRIC UTILITIES.

Requires the Public Utilities Commission to consider whether approving a proposed merger or acquisition would or would not further the State's renewable energy goals.  Establishes a process to ensure that when an application for the proposed acquisition, merger, or consolidation of an electric utility company is filed with the PUC by an acquiring entity that is an investor-owned utility, alternative applications filed by acquiring entities that operate under a non-investor-owned utilities ownership model will be concurrently reviewed.  Requires an acquiring entity of an electric utility company to assume and be bound by any existing collective bargaining agreements entered into by the electric utility company, as it applies to covered employees.  Effective 7/1/2050.  (SD2)

RELATING TO INSURANCE.

Allows an insured to authorize the insurer to electronically remit claim proceeds to the insured's mortgagee when a homeowners insurance policy that covers a mortgaged property allows for the payment of proceeds by issuing a check.  Requires a mortgagee in receipt of electronic delivery of claim proceeds to deliver the proceeds of the claim to the insured in accordance with the mortgage agreement and the insurance policy.  Effective 7/1/2050.  (SD2)

Requires the Department of Land and Natural Resources to establish an independent program relating to the prevention, control, and extinguishment of wildland fires within forest reserves.  Authorizes the Administrator of Forestry and Wildlife to establish and maintain facilities for the performance of fire protection, fire prevention, pest control, and forest and range protection and enhancement activities.  Requires the State Fire Council to amend the State Fire Code to require certain owners and occupants of properties located in hazardous fire areas to maintain effective firebreaks within thirty feet of the property and to practice other fire prevention activities.  Establishes the Community Fuels Reduction Project to be administered by the Department of Land and Natural Resources.  Requires reports to the Legislature.  Appropriates funds.  (SD2)

Requires the Department of Corrections and Rehabilitation, in collaboration with various agencies and upon request of the inmates, to assist inmates in obtaining the inmates' civil identification card, birth certificate, social security card, and other relevant identification necessary for successful reentry into society, as soon as practicable.  Requires the Department of Corrections and Rehabilitation to initiate the process of obtaining identifying documents for inmates released to work furlough, extended furlough, or community placement programs, by providing the forms necessary for the inmate to obtain civil identification cards and other identifying documents to the inmate as soon as practicable.  (SD1)

Clarifies that the importation of any item or material infested or infected with an insect or other animal, disease, or other pest is prohibited.  Authorizes the Department of Agriculture to inspect any item imported or moved into the State from another part of the continental United States or between the Hawaiian Islands.  Prohibits the sale of merchandise that a seller knows is infested or infected with a pest.  Authorizes the Department of Agriculture to compel the quarantine, treatment, or destruction of certain materials.  Clarifies penalties for violations.  Effective 4/23/2057.  (SD2)

Beginning 7/1/2027, requires the State Historic Preservation Division of the Department of Land and Natural Resources to contract its review of proposed state projects, and projects affecting historic properties to third-party consultants if the projects involve the development of affordable housing and the division, after an initial evaluation, determines it will not be able to complete its review within 60 days.  Establishes requirements for qualified third-party consultants providing review services.  Requires the project proponent to pay for the reasonable fee requirements of the third-party consultant.  Allows the project proponent to contract or sponsor with any county, housing authority, non-profit organization, or person, to meet the third-party consultant fee requirement.  Requires the Department of Land and Natural Resources to publish a draft of its proposed rules within 1 year, and within 1 year thereafter, present its proposed final rules to the Board of Land and Natural Resources.  Appropriates funds.  Effective 7/1/2050.  (SD2)

Prohibits foreign entities and foreign-influenced business entities from making contributions, expenditures, electioneering communications, or donations for election purposes.  Allows every business entity that contributes or expends funds in a state election to certify that the entity is not and will not be a foreign corporation or foreign-influenced business entity if the entity intends to make contributions or expenditures within an election cycle.  Specifies that if the conditions that determine whether a business entity qualifies as a foreign-influenced business entity are held unconstitutional by a final judgment, including all appeals, the Campaign Spending Commission is required to establish revised conditions that are constitutional.  Requires noncandidate committees making only independent expenditures to obtain a statement of certification from each top contributor required to be listed in an advertisement.  (SD2)

Requires health insurers and pharmacy benefit managers to reduce an enrollee's defined cost sharing for a prescription drug by a price amount equal to at least one hundred per cent of all rebates received, or to be received, in connection with the dispensing or administration of the prescription drug.  Requires a pharmacy benefit manager to submit a certification to the Insurance Commissioner by January 1 of each calendar year certifying compliance with the cost sharing requirements.  Establishes protections for the publishing of certain confidential or proprietary information by health insurers, pharmacy benefit managers, or plan sponsors that perform health care or administrative services on behalf of a health insurer or pharmacy benefit manager.  Requires that the final reimbursement paid to a pharmacy by a pharmacy benefit manager shall be in an amount not less than the national average drug acquisition cost for the prescription drug at the time the drug is dispensed, plus a professional dispensing fee in an amount not less than the most recent Hawaii Medicaid dispensing fee as approved by the Centers for Medicare and Medicaid Services.  Prohibits a pharmacy benefit manager from offering reimbursement rates or incentives to a non-affiliated pharmacy in an amount less than those offered to an affiliated pharmacy for providing the same prescription drug.  Effective 12/31/2050.  (SD1)
