RELATING TO STORMWATER MANAGEMENT SYSTEMS. Prohibits counties from permitting or allowing retention or detention ponds to be constructed except under certain conditions. Establishes safety requirements for retention and detention ponds statewide. Requires the department of health to conduct a survey of existing retention and detention ponds statewide.

RELATING TO RECREATIONAL FACILITIES. Requires all playgrounds located in state parks and on public school grounds to include special needs recreational playground equipment as part of the recreational apparatuses by 6/30/2027, including at a minimum a wheelchair accessible swing set. Establishes the Special Needs Recreational Playground Equipment Special Fund. Appropriates funds.

RELATING TO THE PUBLIC LAND TRUST WORKING GROUP. Appropriates moneys to the Office of Hawaiian Affairs to facilitate the hiring of necessary staff and the purchase of equipment and professional services on behalf of the public land trust working group.

RELATING TO LAND LEASES. Prohibits the State from leasing any public lands, or extending the lease of any public lands, to any individual, corporation, or federal agency that is in arrears in the payment of certain moneys to the State, noncompliant with a consent decree or memoranda of agreement with the State that requires environmental maintenance or remediation with regard to the subject public lands, or convicted of a crime. Requires certification by the Office of the Governor before the issuance or extension of any federal lease that the individual, corporation, or federal agency is in good standing with the State. Provides that, if any existing lessee of public lands is found not to be in good standing with the State as of the effective date of this Act, the lessee shall have three years, or until the end of the lease term, whichever is sooner, to correct the violation or the lease shall be terminated.

RELATING TO ADAPTATION PATHWAYS PLANNING. Requires the Hawaii Climate Change Mitigation and Adaptation Commission to develop adaptation pathways plans to modify and relocate development and associated infrastructure away from critically vulnerable areas to locations outside of sea level rise and coastal flooding exposure area. Appropriates funds.

RELATING TO SHORELINE MANAGEMENT AREAS. Requires the valuation of development that determines the necessity of a special management area minor permit or special management area use permit to be adjusted annually for inflation.

RELATING TO RESTORATION OF BEACH LANDS. Amends the definition of beach restoration to include activities undertaken to maintain and improve eroded beaches and degraded dune systems through the management of sand and native vegetation, placement of sand, and activities undertaken to remove abandoned and remnant materials that pose a risk to public and ecosystem health.

RELATING TO LANDFILLS. Extends the landfill buffer zone from one-half mile to one mile. Requires the landfill buffer zone to apply to lands in the state conservation district and lands designated as national conservation areas.

RELATING TO PUBLIC LANDS. Authorizes the Board of Land and Natural Resources to lease public lands for recreational-residential use by public lottery and restrict participation in the public lottery to residents of the county in which the leased land is located.

RELATING TO UPDATING PUBLIC LAND LEASES ISSUED PURSUANT TO CHAPTER 171, HAWAII REVISED STATUTES. Requires that lease extensions approved by the Board of Land and Natural Resources be drafted on forms that reflect contemporary leasing practices and policies of the Board, and which shall control over conflicting or inconsistent provisions in the lease being extended.

RELATING TO A STATE HISTORIC PRESERVATION INCOME TAX CREDIT. Reenacts the Historic Preservation Income Tax Credit, establishes a cap of the tax credit at $1,000,000, for taxable year 2025 to taxable year 2030, respectively, and repeals the tax credit on December 31, 2030.

RELATING TO HISTORIC PROPERTY. Amends the definition of "historic property" under the State's historic preservation program to include only property that predates Statehood Day and, with respect to buildings and structures, is registered on the Hawaii Register of Historic Places.

RELATING TO THE GREEN JOBS YOUTH CORPS. Makes appropriations to the Department of Land and Natural Resources to continue the Green Jobs Youth Corps program.

RELATING TO NON-GENERAL FUNDS. Closes or reclassifies certain non-general funds of the Department of Land and Natural Resources, pursuant to certain recommendations made by the Auditor in Auditor's Report No. 24‑08.

RELATING TO GOVERNMENT. Provides for the transfer of certain parcels in the Liliha Civic Center area and Iwilei Fire Station area from various state agencies to the City and County of Honolulu. Provides for the transfer of the parcel of land on which Alii Place is sited from the City and County of Honolulu to the State. Repeals the sunset provision of Act 4, SLH 2024. Requires the City and County of Honolulu to accept the properties transferred in satisfaction of all amounts owed by Hawaii Housing Finance and Development Corporation under the Kapolei roadways, drainage, and sewer settlement. Exempts the land transferred from the definition of public lands for purposes of chapter 171, HRS.

RELATING TO OCEAN USER SAFETY. Authorizes the Board of Land and Natural Resources to issue interim rules regarding commercial and recreational use of water sports equipment.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
