RELATING TO EMPLOYMENT IN THE STATE HISTORIC PRESERVATION PROGRAM. Amend sections 6E-3 and 76-16(b), HRS, to allow the Department of Land and Natural Resources to employ both civil service and non-civil service professional and technical staff in its State Historic Preservation Program.

RELATING TO TORT LIABILITY. Clarifies that persons who enter private property for recreational purposes have no cause of action, unless exempted under law. Requires courts to award attorneys' fees and costs to landowners if plaintiffs bring unreasonable actions. Establishes, as a matter of law, that persons participating in outdoor recreational activities accept the inherent risks, dangers, or hazards in the activities. Clarifies the definitions for "recreational purpose" and "recreational user".

RELATING TO THE COUNTIES. Authorizes counties, after adoption of an ordinance, to sell private property after all notices, orders, and appeal proceedings are exhausted, and to use those revenues to pay unpaid civil fines related to that property.

RELATING TO PROPERTY MAINTENANCE. Requires owners, lessees, or managers of real property to maintain their property and establish penalties for failure to do so. Allows for exceptions.

RELATING TO PERMITS. Establishes an exemption from applicable county permit requirements for repetitive construction projects for facilities under the control of any state department or agency, under certain conditions. Clarifies that contracts for the construction, renovation, or repair of facilities under the control of the department of education, university of Hawaii, or school facilities authority shall be exempt from county permitting requirements that related off-site improvements be made by the contracting government agency as a condition to the issuance of any permit.

RELATING TO BEACH MANAGEMENT ON THE NORTH SHORE OF OAHU. Extends the deadline for the university of Hawaii sea grant college program to submit the north shore beach management plan to the governor and legislature.

RELATING TO FISHPONDS. Establishes a fishpond inventory working group within the University of Hawaii Sea Grant College Program to create an inventory and map of all state-owned fishponds and conduct a literature review. Appropriates funds.

RELATING TO STATE WATER CODE PENALTIES. Adds a minimum penalty of $50 and a maximum penalty of $60,000 per violation of the State Water Code and makes each day that a violation exists or continues to exist a separate offense. Requires the Commission on Water Resource Management to determine the amount of the penalty based on the circumstances of the violation.

RELATING TO RED HILL. Establishes a WAI Policy Coordinator for coordination of Red Hill WAI initiatives. Creates the Red Hill Remediation Special Fund.

RELATING TO LAND RESTORATION. Creates the Aloha Aina Land Trust to rehabilitate and manage lands transferred by the United States military to the State after the leases for those lands expires. Appropriates funds.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
