RELATING TO THE LANDLORD TENANT CODE. Establishes a three-year Residential Landlord-Tenant Code Working Group within the Department of the Attorney General. Requires an initial report to the Legislature prior to the Regular Session of 2026 and a final report no later than 7/1/2028. Effective 7/1/3000. (HD1)

RELATING TO HOUSING. Prohibits the legislative body of a county from making imposing stricter conditions than the Hawaii Housing Finance and Development Corporation, stricter area median income requirements, or a reduction in fee waivers to housing development proposals that would increase the cost of the project. RELATING TO CONDOMINIUMS. Amends the conditions and procedures of alternative dispute resolution methods for condominium-related disputes, including the use of evaluative mediation or binding arbitration. Effective 7/1/2050. (HD1)

RELATING TO CONDOMINIUM RESERVES. Requires a detailed budget summary to contain all required information without referring the reader to other portions of the budget or reserve study. Excludes the good faith defense for associations whose boards adopt a budget that omits the required detailed budget summary. Clarifies a unit owner's standing and the association's burden of proving substantial compliance. Effective 7/1/3000. (HD1)

RELATING TO FORECLOSURES. Prohibits sellers of mortgaged properties in a power of sale foreclosure from bundling properties at a public sale and requires each mortgaged property to be bid on separately. Specifies that the sale of a foreclosed property is not final until the earliest of either fifteen days after the public sale, if an eligible bidder submits a subsequent bid or written notice of intent to submit a subsequent bid, or forty-five days after the public sale, if an eligible bidder submits a subsequent bid. Effective 7/1/3000. (HD2)

RELATING TO THE SMALL BUSINESS REGULATORY REVIEW BOARD. Amends the quorum requirements to do business and validate acts of the Small Business Regulatory Review Board. Effective 7/1/2050. (HD1)

RELATING TO CONSUMER PROTECTION. Makes it an unfair or deceptive act or practice for businesses to: offer, display, or advertise the price of live-ticket events or short-term lodging without clearly and conspicuously disclosing the total price; and misrepresent any fees or charges in any offer, display, or advertisement for the sale of live-event tickets or short-term lodging. Effective 7/1/3000. (HD1)

RELATING TO WASTE DISPOSAL FACILITIES. Prohibits landfill units on land in an agricultural district with class A soils. Prohibits the construction, modification, or expansion of any waste or disposal facility for solid waste or hazardous waste on land that is near or above a significant aquifer. Clarifies that beginning July 1, 2025, the existing buffer zone between waste or disposal facilities and residential, school, or hospital property lines applies to municipal solid waste landfill units or components, construction and demolition landfill units, and their components. Prohibits the construction, modification, or expansion of a landfill unit within a no pass zone in a county with a population greater than five hundred thousand, with certain exemptions. Prohibits the use of fly ash, bottom ash, or a combination of fly ash and bottom ash from a municipal waste combustor for certain purposes and imposes requirements on the disposal of these materials. Effective 7/1/3000. (HD2)

RELATING TO THE WAGE AND HOUR LAW. Requires the Department of Labor and Industrial Relations to issue an order of wage payment violation to employers found to be in violation of the State's Wage and Hour Law. Establishes penalties, enforcement, and appeal procedures. Amends the definition of "wage" to clarify that it means compensation for labor or services rendered by an employee, regardless of how it is calculated. Effective 7/1/3000. (HD1)

RELATING TO PUBLIC MEETINGS. Requires board packets to be posted two full business days before a public meeting. Requires boards to provide notice to persons requesting notification of meetings at the time the board packet is made available for public inspection. Effective 7/1/3000. (HD1)

RELATING TO PEDESTRIANS. Establishes a three-year Pedestrian Safety Pilot Program in a county with population of two hundred fifty thousand or less, under certain conditions. Authorizes the Governor to revoke and abolish the Pilot Program and overturn a county's request to opt-out of the Pilot Program. Authorizes a county with a population of over two hundred fifty thousand to participate in the Pilot Program, subject to certain conditions. Requires reports to the Legislature. Requires a driver of a vehicle to yield to a pedestrian when the pedestrian clearly indicates their intention to cross a roadway within a crosswalk. Sunsets 6/30/2028. Effective 7/1/3000. (HD1)

RELATING TO THE HAWAII HOUSING FINANCE AND DEVELOPMENT CORPORATION. Repeals the requirement that the Chairperson of the Hawaii Housing Finance and Development Corporation Board of Directors be a public member. Repeals the prohibition that certain members shall not be eligible to serve as Chairperson of the HHFDC Board of Directors. Effective 7/1/3000. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
