RELATING TO TRANSPORTATION.

Prohibits any vehicle from parking within certain distances of crosswalks with certain exemptions.  Deposits fines collected from street parking restrictions into the Safe Routes to School Program Special Fund.  Specifies that signs or curb marking shall not be required to restrict parking within twenty feet of a crosswalk or intersection.  Designates exemptions.  Effective 7/1/3000.  (HD1)

RELATING TO THE AIRCRAFT RESCUE FIRE FIGHTING UNIT.

Specifies the terms and appointment processes for the Chief of the Aircraft Rescue Fire Fighting Unit of the Airports Division of the Department of Transportation.  Effective 7/1/3000.  (HD1)

RELATING TO TRANSPORTATION.

Conditions the issuance of a certificate of inspection upon a vehicle not being equipped with a noisy muffler or exhaust system.  Requires rules regarding safety check inspections to ensure that a motorcycle, moped, or motor vehicle is not equipped with a noisy muffler or exhaust system.  Suspends, revokes, or refuses renewal of a permit for an official inspection station upon a third or subsequent wilful violation of any rule regarding inspecting a noisy muffler or exhaust system.  Increases the maximum fine for motorcycle and moped owners that violate noisy muffler laws.  Clarifies the types of mufflers that are prohibited, except for certain motorcycles and mopeds.  Includes repairing or installing a noisy muffler or exhaust system as a prohibited practice for motor vehicle repair laws.  Effective 7/1/3000.  (HD1)

Prohibits persons under the age of sixteen from driving a moped and persons under the age of twenty-one from driving a moped without a helmet.  Effective 7/1/3000.  (HD1)

RELATING TO HIGHWAY SAFETY.

Requires all skateboard users under the age of eighteen to wear a helmet while operating a skateboard.  Effective 7/1/3000.  (HD1)

RELATING TO VEHICLE TITLE TRANSFERS.

Clarifies that proof that a transferor has filed required notice forms serves as a complete defense to any action brought against the transferor for an act or omission, civil or criminal, arising out of the use, operation, or abandonment of the vehicle by another person.  Requires, by 12/31/2025, the courts to create new forms permitting transferors to respond to actions arising out of the use, operation, or abandonment of transferred vehicles.  Effective 7/1/3000.  (HD1)

RELATING TO ADMINISTRATIVE DRIVERS LICENSE REVOCATION.

Extends the time restriction in which the Hawaii Administrative Drivers License Revocation Office is required to issue a written review decision of a notice of administrative revocation of a person's driver license.

RELATING TO HIGHWAY SAFETY.

Amends the administrative process at the Administrative Driver's License Revocation Office.  Establishes a tiered administration revocation period of a driver's license for those arrested for operating a vehicle under the influence of an intoxicant.  Effective 7/1/3000.  (HD1)

Status

RELATING TO MOTOR VEHICLES.

Part I:  Increases the penalty for a third or subsequent offense of excessive speeding to a class C felony.  Authorizes the court, as part of the person's sentencing for the third or subsequent offense, to order that the vehicle used by the person in the commission of the offense be subject to forfeiture.  Requires a repeat offender convicted of a class C felony for excessive speeding be subject to identification processing, including fingerprinting and photographing.  Part II:  Establishes penalties for noncompliance with the maximum speed limit under an automated speed enforcement system and specifying that any summons or citations resulting from noncompliance shall not be recorded on a person's traffic abstract and used for insurance purposes.  Part III:  Requires a person who was convicted of certain traffic offenses or granted a deferred acceptance of a guilty or nolo contendere plea or a conditional discharge of the offense to be ordered by the court to report for identification processing.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
