RELATING TO MENTAL HEALTH. Clarifies the procedures for emergency transportation, examination, and hospitalization for individuals who may be mentally ill or suffering from substance abuse who are imminently dangerous to self or others. Establishes limitations on liability related to emergency procedures. Requires treatment providers to provide relevant information to the Attorney General for purposes of preparing an assisted community treatment petition. Expands the notice requirements for an emergency hospitalization to include an individual's health care surrogate and clarifies when an individual can waive notice to family members. Removes the authority of the Family Court to appoint a legal guardian or conservator in involuntary hospitalization proceedings. Removes the requirement that psychiatric facilities wait for a response on a notice of intent to discharge an involuntary hospitalization patient prior to discharge. Clarifies the circumstances under which a subject of an assisted community treatment order can be administered medication over objection. Establishes limitations on liability for assisted community treatment providers. Allows a single psychiatrist, rather than a panel of three, to provide the administrative authorization for medical treatment over objection. Effective 12/31/2050. (HD1)

RELATING TO HEALTH CARE. Adopts the Uniform Health Care Decisions Act(2023), as modified, to replace chapters 327E and 327G, HRS. Effective 7/1/3000. (HD1)

RELATING TO THE UNIFORM CONTROLLED SUBSTANCE ACT. Updates chapter 329, HRS, to make it consistent with amendments in the Federal Controlled Substances Act as required under section 329-11, HRS. Effective 7/1/3000. (HD1)

RELATING TO EXCITED DELIRIUM. Prohibits excited delirium from being recognized as a valid medical diagnosis or cause of death in the State. Prohibits a medical examiner, coroner, or health care provider from stating on a certificate of death or in any report that the cause of death was excited delirium. Prohibits law enforcement officers from using the term excited delirium to describe an individual in an incident report. Establishes a new Hawaii Rule of Evidence that deems evidence that a person experienced or suffered an excited delirium inadmissible in a civil action. Effective 7/1/3000. (HD1)

RELATING TO HARM REDUCTION. Amends the distribution system of sterile needles and syringes under the Sterile Needle and Syringe Exchange Program from a one-to-one exchange system to a needs-based distribution system. Authorizes non-injection drug user participation in the Program. Modifies liability for Program participants, staff, and law enforcement officers. Effective 7/1/3000. (HD1)

RELATING TO ADMINISTRATIVE ORDERS. Requires any order to cease and desist issued by the Director of Health that is administratively appealed to remain in effect during the appeals process.

RELATING TO MEDICAL CANNABIS. Authorizes the Department of Health to impose penalties and take enforcement actions for violations of the medical cannabis laws. Effective 1/1/2025, retroactively repeals the prohibition against primary caregivers cultivating medical cannabis for their qualifying patients, and authorizes primary caregivers to cultivate cannabis in an amount not to exceed an adequate supply for the qualifying patient. Effective 6/28/2025, extends for two years the sunset on the interim rules adopted by the Department of Health and extends for four years the sunset date for the exemption from civil service of personnel hired by, or contracts entered into by, the Department of Health. Effective 12/31/2050. (HD2)

RELATING TO ADMINISTRATIVE LICENSURE ACTIONS AGAINST SEX OFFENDERS. Requires the Director of Commerce and Consumer Affairs and certain licensing boards to automatically revoke and refuse to renew, restore, or reinstate the professional licenses, registrations, or certifications of registered sex offenders. Effective 7/1/3000. (HD1)

RELATING TO MEDICAL RECORDS. Repeals the requirement for the Department of Health to approve a health care provider's arrangement for the retention and preservation of patients' medical records prior to the provider ceasing operations. Clarifies that retention and preservation of medical records must be consistent with federal and state regulations and requires providers to notify patients on how to access or request copies of their medical records. Effective 7/1/3000. (HD1)

RELATING TO CIVIL RIGHTS. Establishes that it shall be an unlawful discriminatory practice for places of public accommodation to deny a person with a disability full and equal enjoyment of, or information related to, their goods, services, facilities, privileges, advantages, or accommodations using information and communication technology intended for use by the general public as applicants, participants, customers, clients, or visitors. Establishes exceptions. Effective 7/1/3000. (HD1)

RELATING TO MENTAL HEALTH SERVICES FOR CHILDREN AND ADOLESCENTS. Clarifies and updates the responsibilities of the Child and Adolescent Mental Health Division of the Department of Health to reflect the current mental health systems of care that address the mental health needs of children and adolescents in the State. Effective 7/1/3000. (HD1)

RELATING TO FAMILY. Establishes an exemption from mediation in paternity proceedings where there are allegations of domestic abuse. Clarifies the exemption from mediation in divorce proceedings as it relates to domestic abuse. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
