RELATING TO FIREARMS. Prohibits a person from lending a firearm to a person who does not have a firearm permit or does not have a registered firearm. Requires an adult who is borrowing a firearm to have either a firearm permit or a registered firearm, and not be prohibited to own or possess a firearm. Specifies that an adult who is twenty-one years of age or older may be lent a rifle or shotgun for a period not to exceed twelve hours. Repeals the authorization to use a rifle or shotgun outside of the State for up to seventy-five days. Repeals the authorization to lend a rifle or shotgun without a permit.

RELATING TO HARASSMENT BY STALKING. Makes harassment by stalking a class C felony.

RELATING TO CRIMINAL HISTORY RECORD CHECKS. Deletes the term "agent of the contractor" in sections 28-17 and 846-2.7, HRS, to comply with requirements of the Federal Bureau of Investigation. The Federal Bureau of Investigation deemed the term overly broad for purposes of accessing its criminal history background information. Clarifies that "contractor's employees" who have access to federal tax information held by the Department of the Attorney General may be subject to fingerprint-based background checks.

RELATING TO FIREARMS REPORTING. Amends the annual reporting requirements imposed on the Department of the Attorney General and the chief of police of each county regarding licenses to carry firearms.

RELATING TO CONTENTS OF CITATIONS. Clarifies that the omission of certain information or any error in a citation does not constitute ground for dismissal of a charge or for reversal of a conviction, if the omission or error did not prejudice the defendant.

RELATING TO CIVIL RIGHTS PROTECTIONS. Requires state and local law enforcement agencies to notify an individual of their rights when in law enforcement agency custody before any interview with United States Immigration and Customs Enforcement on certain matters regarding immigration violations. RELATING TO MARRIAGE OF MINORS. Raises the minimum age to enter into marriage from sixteen to eighteen years of age. Repeals the authority of parents and the family court to consent to a minor's marriage. Repeals spousal cohabitation after the parties attain legal age as an exception for an annulment based on nonage. Repeals exemptions for sexual assault of a minor if the perpetrator is married to the minor. Makes conforming amendments. Effective 7/1/3000. (HD1)

RELATING TO THE OFFENSE OF PROMOTING PORNOGRAPHY FOR MINORS. Authorizes the offense of Promoting Pornography for Minors to be instituted by written information.

RELATING TO CRIMES AGAINST ELDERS. Establishes strict liability for crimes against elders with respect to the attendant circumstance that the victim was sixty years of age or older. Effective 7/1/3000. (HD1)

RELATING TO CRIMES AGAINST PROTECTIVE SERVICES WORKERS. Specifies that intentionally or knowingly causing bodily injury to a protective services worker who is engaged in the performance of the worker's duties is a class C felony. Clarifies that a protective services worker is a public servant for the purposes of terroristic threatening in the first degree. Effective 7/1/3000. (HD1)

RELATING TO COVERED OFFENDER REGISTRATION. Amends covered offender registration laws to include offenders who, while acting in a professional capacity, commit either the offense of sexual assault in the fourth degree or sexual assault in the second degree against a minor who is at least sixteen years old. Provides that the exception to public access requirements does not apply when the covered offense was committed against a minor. Requires a person who is required to report every year under the covered offender registration requirements to report during the thirty-day period following the offender's birthday, rather than from the offender's actual date of birth. Specifies how certain covered offenses are to be tiered for purposes of seeking termination of registration requirements. Effective 7/1/3000. (HD1)

RELATING TO UNCREWED AIRCRAFT OFFENSES. Increases the penalty for using an uncrewed aircraft in the furtherance of the commission of a felony.

RELATED TO SUMMARY POSSESSION. Requires that a current general excise tax license number for any rental income be filed with the complaint to the court for summary possession proceedings. Requires the Judiciary to submit an annual list of certain information regarding summary possession cases to the Department of Taxation. Effective 7/1/3000. (HD1)

RELATING TO EVICTION RECORDS. Requires that the courts make a good faith and diligent effort to seal all court records of any eviction proceeding within a reasonable time if certain conditions are met. Authorizes the court to seal certain eviction records upon motion by a tenant who is able to demonstrate that certain conditions apply. Requires the clerk of the court to provide access to sealed eviction records to the tenant. Makes it a discriminatory practice to discriminate against a person based on the knowledge or belief that the person has a sealed eviction record. Prohibits discrimination in real property transactions against a person with a sealed eviction record. Effective 7/1/3000. (HD2)

RELATING TO ATTORNEYS' FEES. Limits the accrued attorneys' fees and costs in matters relating to, or actions brought as a result of, construction defects to twenty-five per cent of the recovery amount. Effective 7/1/3000. (HD1)

RELATING TO COLLABORATION WITH THE FEDERAL GOVERNMENT. Allows state and county law enforcement agencies to collaborate with the federal government for immigration purposes in only limited, specific circumstances.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
