RELATING TO LEGISLATIVE VACANCIES.

Establishes that if a state legislative vacancy occurs due to the death or permanent incapacitation of the prior incumbent before a primary election, but after the close of filing for that election, and the prior incumbent was the only person whose name appeared on any ballot for that seat for that election, the Governor's appointment of a replacement shall be valid for both the unexpired term and the next succeeding term.  Effective 1/1/2525.  (SD1)

RELATING TO INSURANCE.

Allows an insured to authorize the insurer to electronically deliver a claim check to the insured's mortgagee when a homeowners insurance policy that covers a mortgaged property allows for the payment of proceeds by issuing a check.  Requires a mortgagee in receipt of electronic delivery of a claim check to deliver the proceeds of the claim to the insured in accordance with the mortgage agreement and the insurance policy.  Effective 7/1/2050.  (SD1)

Establishes processes and requirements for associations to impose fines against unit owners, tenants, and guests for violations of the declaration, bylaws, or house rules.  Prohibits associations from charging attorneys' fees with respect to any fines that are not deemed collectable.  Effective 7/1/2050.  (SD1)

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Allows impasses and disputes relating to the amounts of State and county contributions to the Hawaii Employer-Union Health Benefits Trust Fund to be resolved by arbitration.  Repeals the prohibition against strikes by members of bargaining units on the issue of the amounts of State and county contributions to the Trust Fund.  Effective 7/1/2050.  (SD1)

RELATING TO FORECLOSURES.

Prohibits sellers of foreclosed homes from bundling properties at a public sale and requires each foreclosed home to be sold separately.  Specifies that the sale of a foreclosed property is not final until either fifteen days after the public sale or forty-five days if an eligible bidder submits a subsequent bid or written notice of intent to submit a subsequent bid.  Effective 7/1/2050.  (SD1)

RELATING TO COLLECTIVE BARGAINING IN PUBLIC EMPLOYMENT.

Clarifies that the Hawaii Labor Relations Board has the authority to enforce its own orders issued pursuant to state law governing collective bargaining in public employment, in addition to discretion to seek judicial enforcement of its orders under the Hawaii Employment Relations Act.  Effective 7/1/2050.  (SD1)

RELATING TO COMMUNITY OUTREACH BOARDS.

Defines community outreach board to mean a board established to serve in a community advisory capacity under a county commission or a county department.  Includes community outreach boards in existing provisions of the Sunshine Law relating to neighborhood boards.  Authorizes neighborhood board and community outreach board members to attend meetings or presentations related to official board business statewide.  Effective 1/1/2491.  (SD1)

RELATING TO ARSON.

Authorizes periods of imprisonment for individuals with previous arson convictions.  Authorizes additional penalties for arson crimes that endanger vulnerable areas.  Requires restitution for victims of arson who experienced property damage.  Effective 7/1/2077.  (SD1)

RELATING TO TRAFFIC.

Provides that if a law enforcement officer lawfully stops a motor vehicle and the operator is cited for driving without a valid license, the officer shall not permit the operator to resume the use of the motor vehicle.  Requires the motor vehicle to be moved by a licensed driver or towed at the owner's expense.  Provides that the cited operator is responsible for arranging the operator's transportation from the scene of the stop.  Effective 7/1/2050.  (SD1)

RELATING TO ANIMAL ENDANGERMENT.

Prohibits intentionally leaving or confining pet animals in a vehicle under conditions that endanger their health, safety, or well-being.  Allows law enforcement officers, animal control officers, and firefighters to enter an unattended vehicle to protect the health, safety, or well-being of a pet animal that is endangered by being left or confined in an unattended vehicle.  Allows private citizens to rescue a pet animal that has been left in an unattended vehicle under certain circumstances.  (SD1)

Authorizes the Land Use Commission to designate important agricultural lands and adopt maps for the designated lands in counties that fail to identify and recommend important agricultural lands by December 31, 2027.

RELATING TO GOVERNMENT RECORDS.

Amends the Uniform Information Practices Act to require each contract to perform a government function to expressly require the contractor to retain records in accordance with the retention schedule of the agency and provide the agency with access to all records subject to the Uniform Information Practices Act; define "government function" and "trade secret"; clarify that "government record" includes information that is created, received, maintained, or used by a private person in performance of a government function contract; and prohibit agencies from denying a request for access to records of a contractor used in the performance of a government function on the basis of trade secret or other proprietary information.  Effective 1/1/2491.  (SD1)

RELATING TO HISTORIC PRESERVATION.

Creates a process for expediting the review of residential transit-oriented development on certain parcels within county-designated transit-oriented development zones that have a low risk of affecting historically significant resources.  Authorizes lead agencies, including county governments, to make determinations on the potential effects of a project.  Creates a ninety-calendar-day limit for the Department of Land and Natural Resources to concur or not concur with project effect determinations, under certain conditions.  Establishes certain requirements for the notification and submission of projects under historic preservation law.  Provides that projects with written concurrence are exempt from further review unless there is a change to the project or additional historic properties, aviation artifacts, or burial sites are identified within the project area, under certain conditions.  Requires community development districts and state or county housing projects to undergo a programmatic review.  (SD1)

Authorizes the Department of Commerce and Consumer Affairs and certain licensing boards to automatically revoke and refuse to renew, restore, or reinstate the professional licenses of registered sex offenders.  Effective 7/1/2050.  (SD1)

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Clarifies that Act 130, Session Laws of Hawaii 2024, shall take effect on either the date of the Secretary of the Interior's notification letter to the Congressional Committee Chairpersons that this Act meets none of the criteria in title 43 Code of Federal Regulations section 48.20, or on the date that the United States Congress approval becomes law.  (SD1)

RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY.

Allows the Hawaii Public Housing Authority to sell, donate, or dispose of property abandoned or seized in federal public housing projects.  Requires the HPHA to notify the known owner of the abandoned or seized property.  Establishes procedures for persons entitled to the abandoned or seized property.  (SD1)

RELATING TO MEDICAL CANNABIS.

Retroactively repeals the sunset date of the authorization for primary caregivers to cultivate medical cannabis for their qualifying patients.  Increases the number of qualifying patients a primary caregiver is authorized to care for from 1 to 5 patients.  Establishes that each location used by primary caregivers to cultivate cannabis can be used to cultivate cannabis for not more than five qualifying patients.  Extends the effective date of interim rules adopted by the Department of Health pursuant to section 329D-27, Hawaii Revised Statutes, to 7/1/2027.  Extends the sunset date for the exemption of personnel hired by or contracts entered into by the Department of Health pursuant to Act 241, Session Laws of Hawaii 2015, from civil service to 6/30/2027.  Effective 12/31/2050.  (SD1)

RELATING TO CRITICAL INFRASTRUCTURE.

Enhances sharing of critical infrastructure information between infrastructure owners and operators and the state government.  Defines and protects "critical infrastructure information" that is crucial for direct support of the security and resilience of the State.  Provides homeland security partners with reassurance that their proprietary information provided to the state government will be protected from disclosure.  Effective 7/1/2077.  (SD1)
