RELATING TO STORMWATER MANAGEMENT SYSTEMS. Requires the counties to adopt ordinances for the regulation of retention and detention ponds. Requires the counties to conduct a survey of existing retention and detention ponds and make a report to the Legislature. Appropriates funds as a grant-in-aid to the counties. Effective 7/1/3000. RELATING TO CORRECTIONS. Restricts the use of restrictive housing in state-operated and state-contracted correctional facilities, with certain specified exceptions. Requires the Department of Corrections and Rehabilitation to develop written policies and procedures regarding restrictive housing by 7/1/2026. Requires the Hawaii Correctional System Oversight Commission to review certain housing placements. Requires the Department by 4/1/2026 to develop policies and procedures to review committed persons placed in restrictive housing and develop a plan for committed persons currently in restrictive housing. Requires a report to the Legislature and Hawaii Correctional System Oversight Commission. Effective 7/1/3000. (HD2)

RELATING TO THE HAWAII NATIONAL GUARD. Allows the Commander of the Hawaii Air National Guard to hold the rank authorized by the Department of the Air Force, which is currently Major General. Provides the Adjutant General with the flexibility to assign either the Chief of Staff or the Assistant Adjutant General to lead the Hawaii Air National Guard. Authorizes the pay and allowances for the Chief of Staff of the Hawaii Air National Guard to be determined according to the pay tables of the Regular Air Force of the United States. (SD1)

RELATING TO MENTAL HEALTH. Establishes a two-year Mental Health Emerging Therapies Pilot Program within the Office of Wellness and Resilience. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO THE FILM INDUSTRY. Establishes the Island Film and Media Production Investment Fund. Provides an additional five per cent tax credit to qualified productions with a workforce of at least eighty percent local hires. Adds a requirement that productions contact all local labor unions servicing Hawaii's film industry to qualify for the Motion Picture, Digital Media, and Film Production Income Tax Credit. Requires qualified production costs of a taxpayer that exceed $1,000,000 to be certified by an independent third-party certified public accountant to qualify for the film production tax credit. Increases to an unspecified amount the aggregate cap amount of film production tax credits allowed in any given year. Includes broadcast and streaming platform productions under the film production tax credit. Defines "streaming platform". Applies the GET rate for manufacturers to productions. Exempts from the GET amounts received by a motion picture project employer from a client equal to amounts that are disbursed by the motion picture project employer for employee wages, salaries, payroll taxes, insurance premiums, and employment benefits and payments to loan-out companies. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO ECONOMIC DEVELOPMENT. Amends the Transient Accommodations Tax rate beginning on 1/1/2027. Assesses the Transient Accommodations Tax on cruise ship cabins based on the total time the cruise ship is docked at any port in the State. Appropriates funds to DLNR for protection, management, and restoration of the State's natural resources as well as for environmental stewardship, climate and hazard mitigation, and sustainable tourism. Effective 7/1/3000. (HD2)

RELATING TO HAWAIIAN AFFAIRS. Proposed HD2: Amends the membership and responsibilities of the Public Land Trust Working Group established under Act 226, SLH 2022. Requires the Working Group to submit four reports to the Legislature: by 8/1/2026, a first interim report regarding the public land trust inventory; by 12/1/2026, a second interim report regarding Act 178, SLH 2006, financial reporting and accounting; by 6/1/2027, a preliminary draft settlement of the income and proceeds from the pro rata portion of the public land trust; and by 10/1/2027, a final report that includes a final draft settlement. Requires the State, OHA, and other applicable parties to begin preliminary negotiations regarding the final draft settlement by 10/1/2027. Appropriates funds for the Legislative Reference Bureau to retain independent third-party professionals for the public land trust working group and requires matching funds from the Office of Hawaiian Affairs. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
