Status

RELATING TO CONDOMINIUM.

States that the defense of good faith compliance is unavailable to any association whose board adopts a budget that omits the required budget summary.  Clarifies the ability to enforce compliance with budget summary and replacement reserves requirements and provides that an association has the burden of proving compliance.

Status

RELATING TO CONDOMINIUMS.

Clarifies the authority of condominium associations to impose fines for violations of the declaration, bylaws, house rules, or regulations adopted by the condominium association.  Establishes a process for the unit owner or tenant of the unit owner to appeal the imposition of a fine.  Clarifies the responsibilities of unit owners to pay common expense assessments.  Clarifies the rights and process for unit owners to appeal assessments other than common expense assessments.

HB 224

Status

RELATING TO PROPERTY RIGHTS.

Establishes a procedure for immediately removing an unlawful occupant of a dwelling or premises with assistance from law enforcement.  Provides that an unlawful occupant of a dwelling or premises is civilly liable for unpaid utility bills.  Provides that a person who trespasses in or upon a dwelling or premises and intentionally or knowingly damages property in an amount exceeding $999 commits a felony of criminal property damage in the second degree.  Requires the Department of the Attorney General to develop, publish, and make available a complaint form to remove unlawful occupants of residential dwellings.

Status

RELATING TO INSURANCE.

Allows authorized insurers in the State to offer building and hurricane damage insurance for condominium buildings at a lesser rate than the building's prior surplus lines insurance policy for the same coverage.

Status

RELATING TO THE STABILIZATION OF PROPERTY INSURANCE.

Expands the powers of the Hawaii Property Insurance Association and reactivates the Hawaii Hurricane Relief Fund to help to stabilize the property insurance market in the State.  Requires the Insurance Commissioner to conduct a study.  Appropriates moneys.

Status

RELATING TO THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS.

Requires the Director of Commerce and Consumer Affairs to make all business registration applications available online.  Requires all applications to contain certain contact information.

Status

RELATING TO COMMON INTEREST OWNERSHIP COMMUNITIES.

Creates regulation requirements for managers of homeowners' associations, planned community associations, cooperative housing corporations, and condominium unit owners' associations in the State.  Requires licensure of association managers beginning 7/1/2027.  Establishes an Association Manager Licensing Board within the Department of Commerce and Consumer Affairs.

HB 490

Status

RELATING TO INSURANCE.

Requires the Insurance Commissioner to develop comprehensive standards and requirements for condominium associations and developers to obtain property insurance through self-insurance and mutual insurance, and examine and evaluate the feasibility of implementing guaranteed buyback programs and investment-based protection funds.

HB 108

Status

RELATING TO INTOXICATING LIQUOR.

Allows direct shipment of beer and distilled spirits by certain licensees.  Requires the liquor commission of each county to adopt rules and regulations.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
