RELATING TO AQUACULTURE.

Authorizes the Division of Animal Industry of the Department of Agriculture to adopt, amend, and repeal rules to develop an assessment and approval process to import and move aquatic livestock in the State.  Requires the Aquaculture Program to develop a biological aquatic risk-based framework and biocontainment standards for the aquatic livestock assessment and approval process.  Appropriates funds.  Effective 7/1/2050.  (SD1)

Establishes an agricultural crime prevention program within the Department of Agriculture to provide grants, education, administrative enforcement, and other services for the benefit of the State's agricultural industry.  Clarifies, creates, and strengthens laws regarding crimes and violations related to agriculture or agricultural lands and hunting on private agricultural lands.  Establishes clear distinctions between administrative and criminal penalties.  Appropriates funds.  Effective 7/1/2050.  (SD1)

RELATING TO THE AGRIBUSINESS DEVELOPMENT CORPORATION.

Authorizes the Agribusiness Development Corporation to acquire by condemnation any real property or interest in real property for the purposes of Chapter 163D, HRS.  Requires the Agribusiness Development Corporation to make a determination that the property is necessary for the corporation's immediate or future use.  Prohibits real property acquired by condemnation from being subsequently transferred or taken for any other public use without the consent of the Agribusiness Development Corporation.  Effective 7/1/2050.  (SD2)

RELATING TO INVASIVE SPECIES.

Establishes a 2-year coconut rhinoceros beetle eradication pilot program under the Department of Land and Natural Resources that incentivizes community members to collect and submit the coconut rhinoceros beetle and its larvae for compensation.  Requires a report to the Legislature.  Appropriates moneys.  (SD2)

Establishes a Plant Nursery Registry Program to regulate the sale of nursery stock.  Requires certain plant nurseries to register with the Department of Agriculture.  Establishes penalties.  Effective 7/1/2050.  (SD2)

RELATING TO INVASIVE SPECIES.

Clarifies that the importation of any item or material infested or infected with an insect or other animal, disease, or other pest is prohibited.  Authorizes the Department of Agriculture to inspect any item imported or moved into the State from another part of the continental United States or between the Hawaiian Islands.  Prohibits the sale of merchandise that a seller knows is infested or infected with a pest.  Authorizes the Department of Agriculture to compel the quarantine, treatment, or destruction of certain materials.  Clarifies penalties for violations.  Effective 4/23/2057.  (SD2)

RELATING TO BIOSECURITY.

Renames the Department of Agriculture as the Department of Agriculture and Biosecurity (Department).  Establishes a Deputy Chairperson for Biosecurity.  Requires the Department to establish an emergency response team to respond to biosecurity events.  Authorizes the Department to establish transitional facilities.  Requires the Department of Commerce and Consumer Affairs to license and train biosecurity inspectors to inspect imported plants and animals.  Requires inspection of various items transported interisland.  Increases penalties for illegally transporting plants, animals, and microorganisms.  Requires the Department to establish government-industry agreements to detect and respond to unwanted organisms in Hawaii.  Authorizes pest management plans to address, contain, or eradicate pests.  Transfers the Hawaii Invasive Species Council from the Department of Land and Natural Resources to the Department.  Authorizes the Department to adopt rules to establish and enforce the Plant Care Component Program.  Authorizes the Department to assess administrative penalties for the enforcement of the program.  Appropriates funds.  Effective 1/1/2050.  (SD2)

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.
