Madame:
Your Committee on Water & Land, to which was referred S.C.R. No. 3, S.D. 1, entitled:
"SENATE CONCURRENT RESOLUTION AUTHORIZING THE ISSUANCE OF A PERPETUAL, NON-EXCLUSIVE EASEMENT TO THE CITY AND COUNTY OF HONOLULU COVERING A PORTION OF STATE SUBMERGED LANDS AT MAUNALUA, HONOLULU, OAHU, FOR THE STORMWATER MANAGEMENT OUTFALL AND DRAINAGE SYSTEM, AND FOR USE, REPAIR, AND MAINTENANCE OF THE IMPROVEMENTS CONSTRUCTED THEREON,"
begs leave to report as follows:
The
purpose of this measure is to authorize
the issuance of a perpetual, non-exclusive easement to the City and County of
Honolulu covering a portion of state submerged lands at Maunalua, Honolulu,
Oahu, for the stormwater management outfall and drainage system, and for use,
repair, and maintenance of the improvements constructed thereon.
Your Committee finds
that, pursuant to section 171-53(c), Hawaii Revised Statutes, the Board of Land
and Natural Resources may lease submerged lands with prior approval of the
Governor and the prior authorization of the Legislature by concurrent resolution. Your Committee further finds that on February
9, 2018, under agenda item K-3, the Board of Land and Natural Resources
approved the grant of a perpetual, non-exclusive easement for the permanent
replacement of the stormwater management outfall and drainage system identified
in this measure, at gratis consideration, to the City and County of Honolulu. Your Committee concludes that the easement is
necessary for the maintenance and repair of the existing stormwater management
outfall drainage system, and for use, repair, and maintenance of the
improvements constructed thereon.
As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee concurs with the intent and purpose of S.C.R. No. 3, S.D. 1, and recommends that it be referred to your Committee on Finance.
