Madame:

 

     Your Committee on Transportation, to which was referred S.C.R. No. 153 entitled:

 

"SENATE CONCURRENT RESOLUTION REQUESTING THE COUNTY OF MAUI TO FULFILL ITS AGREEMENT WITH THE STATE AND RESOLVE LONGSTANDING JURISDICTIONAL AMBIGUITIES BY COMPLETING THE TRANSFER OF THE HUI ROADS, INCLUDING HUI ROAD F, FROM THE JUDICIARY,"

 

begs leave to report as follows:

 

     The purpose of this measure is to request the County of Maui to fulfill its agreement with the State and resolve longstanding jurisdictional ambiguities by completing the transfer of the Hui Roads, including Hui Road F, from the Judiciary.

 

     Your Committee received testimony in support of this measure from the Judiciary and one individual.

 

     Your Committee finds that prolonged jurisdictional uncertainty over the ownership and maintenance of certain roads, including Hui Road F in West Maui, has led to neglect, unsafe conditions, and confusion among residents.  Despite an agreement between the State and County of Maui to transfer jurisdiction of the Hui Roads from the Judiciary to the County, the transfer remains incomplete, delaying much-needed repairs and maintenance. This measure aims to improve public safety, infrastructure reliability, and quality of life for West Maui residents.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the Director of Transportation of the County of Maui to the Director of Public Works of the County of Maui as a recipient of a certified copy of this measure; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee concurs with the intent and purpose of S.C.R. No. 153, as amended herein, and recommends its adoption in the form attached hereto as S.C.R. No. 153, H.D. 1.
