Sir:
Your Committee on Water and Land, to which was referred S.B. No. 830 entitled:
"A BILL FOR AN ACT RELATING TO COASTAL ZONE MANAGEMENT,"
begs leave to report as follows:
The purpose and intent of this measure is to narrow the scope of the definition of the term "development" in coastal zone management law by excluding reconstruction of certain lawfully constructed structures impacted by certain events.
Your Committee received testimony in support of this measure from the Department of Land and Natural Resources, Office of the Mayor of the County of Maui, LahainaTown Action Committee, Maui Chamber of Commerce, Pacific Rim Land Inc., Grassroot Institute of Hawaii, and four individuals.
Your Committee received comments on this measure from the Office of Planning and Sustainable Development.
Your Committee finds that complicated permitting requirements slow recovery efforts in communities damaged or destroyed by natural disasters. This measure will streamline the rebuilding process for communities affected by such catastrophic events.
Your
Committee has amended this measure by:
(1) Clarifying
that the reconstruction of a lawfully established structure shall only be
excluded from the term "development" if it was damaged or destroyed
in a disaster proclaimed by the Governor or Mayor of the respective county to
constitute a state of emergency or local state of emergency;
(2) Inserting language requiring that the
reconstruction of a lawfully established structure shall comply with the
requirements of the National Flood Insurance Program; and
(3) Making
a technical, nonsubstantive amendment for the purposes of clarity and
consistency.
As affirmed by the record of votes of the members of your Committee on Water and Land that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 830, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 830, S.D. 1, and be referred to your Committee on Ways and Means.
