Madame:

 

     Your Committee on Water & Land, to which was referred S.B. No. 411, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO CAPITAL IMPROVEMENT PROJECTS AT STATE SMALL BOAT HARBORS AND STATE PARKS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Provide the Department of Land and Natural Resources' Division of Boating and Ocean Recreation and the Division of State Parks the flexibility to undertake certain necessary repairs and renovations for existing facilities at the State's small boat harbors and state parks without prior legislative or gubernatorial authorization;

 

     (2)  Establish a notification protocol to ensure that the Legislature is informed of expenditures before they occur; and

 

     (3)  Establish annual reporting requirements relating to those expenditures to the Legislature.  

 

     Your Committee received testimony in support of this measure from the Department of Land and Natural Resources; Activities and Attractions Association of Hawaii; Ocean Tourism Coalition; True Blue Inc., DBA Kauai Beach Boys DBA Da Life Outdoor Gear; Extended Horizons; Sailing Maui Inc.; Shangri-La Sailing Charters; Maui Pacific Divers; Atlantis Submarines; Hawaii Goes Fishing; and one individual.  Your Committee received testimony in opposition to this measure from the Department of Budget and Finance.   

 

     Your Committee finds that although the Department of Land and Natural Resources has the authority to complete certain types of infrastructure work without capital improvement project (CIP) funding or approval, construction and certain types of larger repair work must follow the CIP process.  Your Committee further finds that some of the needed repair work arises after the Legislature has adjourned sine die, resulting in costly delays.  Your Committee believes that granting the Division of Boating and Ocean Recreation and Division of State Parks the flexibility to address certain necessary repairs outside of the CIP process will ensure the basic infrastructure maintenance and repair needs of the State's parks and small boat harbors are addressed in a timely fashion.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 411, S.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 411, S.D. 2, H.D. 1, and be referred to your Committee on Finance.
