Sir and Madam:

Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 405, S.D. 1, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO NEIGHBORHOOD BOARD MEETINGS,"

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

The purpose of this measure is to:

(1) Allow neighborhood boards to discuss and receive information from third-party reports by any government official not included in a publicly noticed agenda; and

(2) Require boards to make decisions on matters raised by third-party reports from any government official at a later meeting where the agenda gives notice of decision‑making on the matter.

Your Committee on Conference finds that valuable information utilized in neighborhood board meetings often comes from third‑party reports from government officials. Your Committee on Conference further finds, however, that the existing Sunshine Law requiring these reports to be included in the neighborhood boards' publicly‑noticed agenda hinders its ability to hear and discuss the issues raised by the report in a timely manner. Therefore, this measure protects the public interest by allowing neighborhood boards to hear and discuss third-party reports from government officials not included in a publicly-noticed agenda, while preserving the integrity of Sunshine Law by requiring any decisions on matters raised to be held at later meetings with proper notice of decision‑making.

Your Committee on Conference has amended this measure by making it effective upon its approval.

As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 405, S.D. 1, H.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 405, S.D. 1, H.D. 1, C.D. 1.
