Madame:
Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 30, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO MOPEDS,"
begs leave to report as follows:
The
purpose of this measure is to prohibit anyone under the age of:
(1) Sixteen from operating a moped; and
(2) Twenty-one from driving a moped without a helmet.
Your Committee received testimony in support of this measure from the Department of Transportation; Department of the Prosecuting Attorney of the City and County of Honolulu; Honolulu Police Department; Keiki Injury Prevention Coalition; and two individuals. Your Committee received testimony in opposition to this measure from Moped Doctors; Hawaiian Style Rentals and Sales; and four individuals.
Your Committee finds that in 2023, there were fifteen moped-related crashes in the State, of which eleven of those riders were not wearing helmets and amongst those eleven riders, seven sustained head and face injuries. Your Committee further finds that motorcycle helmets reduce head injury risk by sixty-nine percent and fatalities by thirty-seven percent. Your Committee believes that helmets are an effective preventative measure for protecting moped operators.
Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 30, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 30, H.D. 2.
