Madame:
Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 284, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO INTERCEPTION OF WIRE, ORAL, OR ELECTRONIC COMMUNICATION,"
begs leave to report as follows:
The purpose of this measure is to:
(1) Require the Department of the Attorney General to provide a written memorandum recommending approval or disapproval of an order authorizing or approving the interception of a wire, oral, or electronic communication to the prosecuting attorney within twenty-four hours of the prosecuting attorney's request to the Department; and
(2) Establish a process for emergency applications for emergency orders authorizing or approving the interception of wire, oral, or electronic communications.
Your Committee finds that this measure would expedite the application process for intercepting communications in emergencies, ensuring timely responses to prevent death or injury while maintaining legal oversight.
Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 284, S.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 284, S.D. 1, H.D. 1, and be placed on the calendar for Third Reading.
