Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 1511, S.D. 1, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO HANALEI BAY,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Prohibit vessels longer than seventy-five feet from entering Hanalei Bay; and

 

     (2)  Exempt vessels operated by a federal, state, or county agency from this prohibition.

 

     Your Committee received testimony in support of this measure from the Mayor of the County of Kauaʻi; Hanalei-Wainiha-Hāʻena Community Association; and Hanalei Watershed Hui.  Your Committee received comments on this measure from the Department of Land and Natural Resources.

 

     Your Committee finds that there has been an increase in the number of large vessels mooring in Hanalei Bay, posing a risk to the health and safety of individuals and families participating in ocean activities in the area.  This measure promotes boating and ocean safety and preserves the rural character of Hanalei Town by prohibiting large vessels from entering Hanalei Bay.

 

     Your Committee has amended this measure by changing its effective date to upon approval.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1511, S.D. 1, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 1511, S.D. 1, H.D. 2.
