Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 1447 entitled:

 

"A BILL FOR AN ACT RELATING TO ADMINISTRATIVE ORDERS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require any cease and desist order issued by the Director of Health that is administratively appealed to remain in effect during the appeals process.

 

     Your Committee received testimony in support of this measure from the Department of Health and one individual.

 

     Your Committee finds that the Director of Health is authorized to issue orders to cease and desist to certain state-licensed facilities due to concerns over the health and safety of patients.  This measure ensures that cease and desist orders remain in effect during the administrative appeals process, preventing facilities that have received such orders from continuing operations while the appeals process is underway.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1447 and recommends that it pass Third Reading.
