Sir:

 

     Your Committee on Housing, to which was referred S.B. No. 1413 entitled:

 

"A BILL FOR AN ACT RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to:

 

     (1)  Allow the Hawaii Public Housing Authority (HPHA) to sell, donate, or dispose of property abandoned or seized in federal public housing projects; 

 

     (2)  Require HPHA to notify the known owner of the abandoned or seized property; and

 

     (3)  Create procedures for persons entitled to the abandoned or seized property.

 

     Your Committee received testimony in support of this measure from the Hawaii Public Housing Authority.

 

     Your Committee finds that abandoned or seized property may create a nuisance for tenants of properties operated by HPHA.  As abandoned or seized items require storage until the owner of the property can be contacted, items may remain in HPHA's possession for a long period of time, creating an unnecessary burden for tenants and staff.  Therefore, this measure advances HPHA's operational efficiency by creating uniformity with provisions similar to federal public housing projects.

 

Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the record of votes of the members of your Committee on Housing that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1413, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1413, S.D. 1, and be referred to your Committee on Judiciary.
