Your Committee on Hawaiian Affairs, to which was referred S.B. No. 1408 entitled:

"A BILL FOR AN ACT RELATING TO THE HAWAIIAN HOMES COMMISSION ACT,"

begs leave to report as follows:

The purpose and intent of this measure is to clarify that Act 130, Session Laws of Hawaii 2024, shall take effect on either the date of the Secretary of the Interior's notification letter to the Congressional Committee Chairpersons that Act 130 meets none of the criteria in title 43 Code of Federal Regulations section 48.20, or on the date that the United States Congress approval becomes law.

Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands.

Your Committee finds that section 4 of Act 130, Session Laws of Hawaii 2024, did not accurately note the necessary approval process for proper amendment to the Hawaiian Homes Commission Act, 1920, as amended. This measure will correct this error.

Your Committee has amended this measure by making a technical, nonsubstantive amendment for the purposes of clarity and consistency.

As affirmed by the record of votes of the members of your Committee on Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1408, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1408, S.D. 1, and be referred to your Committee on Judiciary.
