     Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 1408, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE HAWAIIAN HOMES COMMISSION ACT,"

 

begs leave to report as follows:

 

     The purpose of this measure is to clarify that Act 130, Session Laws of Hawaii 2024 (Act 130), which amended the Hawaiian Homes Commission Act to increase the loan limit for direct loans provided by the Department of Hawaiian Home Lands, takes effect on either the date of the Secretary of the Interior's notification letter that Act 130 does not require congressional approval, or on the date that the United States Congress approval becomes law.

 

     Your Committee received testimony in support of this measure from the Department of Hawaiian Home Lands.

 

     Your Committee finds that Act 130 increases the loan limit for direct loans provided by the Department of Hawaiian Home Lands to seventy-five percent of the maximum single residence loan amount allowed in Hawaii by the United States Department of Housing and Urban Development's Federal Housing Administration, rather than the fifty percent as outlined in the Hawaiian Homes Commission Act, 1920.  However, Act 130 contained an error with respect to recognizing the appropriate approval procedure for its enactment.  This measure corrects Act 130 to accurately reflect the necessary approval process for the enactment of laws that amend the Hawaiian Homes Commission Act, 1920.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1408, S.D. 1, and recommends that it pass Second Reading and be referred to your Committee on Finance.
