Sir:

 

     Your Committees on Judiciary and Ways and Means, to which was referred S.B. No. 1402, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO VESSELS IN STATE COMMERCIAL HARBORS,"

 

beg leave to report as follows:

 

     The purpose and intent of this measure is to clarify that the requirements for the securing of mooring lines in state commercial harbors shall not apply to certain vessels.

 

     Your Committees received testimony in support of this measure from the Hawaii Longline Association and General Contractors Association of Hawaii.

 

     Your Committees find that Act 236, Session Laws of Hawaii 2024 (Act 236), was intended to enhance maritime safety by requiring the securing of mooring lines from vessels in state commercial harbors to be performed by labor subject to collective bargaining.  However, certain vessel types either require fewer mooring lines, and are thus simpler to moor, or are staffed by crew well-qualified to execute mooring operations, such as smaller fishing vessels and government-owned vessels, respectively.  This measure eliminates the unnecessary burden placed on those vessels by expanding the exemptions to Act 236.

 

     As affirmed by the records of votes of the members of your Committees on Judiciary and Ways and Means that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 1402, S.D. 1, and recommend that it pass Third Reading.
