Madame:

 

     Your Committee on Water & Land, to which was referred S.B. No. 1393, S.D. 1, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE USE OF PUBLIC LANDS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require the School Facilities Authority to consult with the Department of Education or other impacted department or agency before any transfer or lease of land or property owned or occupied by the Department of Education or other impacted department or agency to the School Facilities Authority.  

 

     Your Committee received testimony in support of this measure from the Department of Education.  Your Committee received comments on this measure from the School Facilities Authority.

 

     Your Committee finds that the School Facilities Authority (Authority) is charged with the responsibility for all public schools' development, planning, and construction related to capital improvement projects that are assigned by the State.  Your Committee further finds that requiring the Authority to consult with the Department of Education or other impacted departments or agencies prior to the transfer of lands to the Authority will ensure the State provides an optimal learning and teaching environment for all students and teachers while maintaining a streamlined land transfer process.

 

     Your Committee has amended this measure by:

 

     (1)  Repealing language requiring the Department of Education to transfer the title of lands held by the Department of Education to the Authority upon request of the Authority; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1393, S.D. 1, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Judiciary & Hawaiian Affairs in the form attached hereto as S.B. No. 1393, S.D. 1, H.D. 2.
