Sir:
Your Committee on Judiciary, to which was referred S.B. No. 1382 entitled:
"A BILL FOR AN ACT RELATING TO THE NATIONAL GUARD,"
begs leave to report as follows:
The purpose and intent of this measure is to create a protected status for National Guard personnel in service to the State by specifying that intentionally or knowingly causing bodily injury to a national guard member in the performance of duty is a class C felony.
Your Committee received testimony in support of this measure from the Department of Defense, Hawaii National Guard, Honolulu Police Department, and one individual.
Your Committee finds that this administration measure will afford protection within the justice system for threats and bodily harm to Hawaii national guard or national guard members of other states in service of the State, such as during civil disturbances and critical state emergencies. This measure will provide national guard members the same protections currently offered to certain law enforcement officers in service to the State.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1382 and recommends that it pass Third Reading.
