Madame:

 

     Your Committee on Public Safety, to which was referred S.B. No. 1382 entitled:

 

"A BILL FOR AN ACT RELATING TO THE NATIONAL GUARD,"

 

begs leave to report as follows:

 

     The purpose of this measure is to specify that intentionally or knowingly causing bodily injury to a National Guard member who is engaged in the performance of duty is a class C felony.

 

     Your Committee received testimony in support of this measure from the Hawaiʻi National Guard; Honolulu Police Department; and two individuals.  Your Committee received testimony in opposition to this measure from one individual.

 

     Your Committee finds that National Guard members serve and protect their communities in times of crisis, such as natural disasters and other emergencies.  Your Committee further finds that this measure establishes an essential legal safeguard to protect National Guard members as they carry out their duties.

 

     As affirmed by the record of votes of the members of your Committee on Public Safety that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1382 and recommends that it pass Second Reading and be referred to your Committee on Judiciary & Hawaiian Affairs.
