Madame:

 

     Your Committee on Economic Development & Technology, to which was referred S.B. No. 1343, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE SMALL BUSINESS REGULATORY REVIEW BOARD,"

 

begs leave to report as follows:

 

     The purpose of this measure is to amend the minimum quorum and voting requirements for the Small Business Regulatory Review Board to conduct its business and validate its actions.

 

     Your Committee received testimony in support of this measure from the Department of Business, Economic Development, and Tourism; and Small Business Regulatory Review Board.

 

     Your Committee finds that existing law entitles the Small Business Regulatory Review Board to eleven members, thereby requiring six members to constitute a quorum to do business.  By lowering the number of members required to achieve quorum by one, this measure maintains the integrity of the Board while allowing it to function with less interruption in the event of vacancies, all to the benefit of Hawaii's small businesses.

 

     Your Committee has amended this measure by:

 

     (1)  Clarifying that quorum will consist of Board members who are appointed and confirmed, rather than members that are currently serving; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Economic Development & Technology that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1343, S.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1343, S.D. 1, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
