Sir and Madam:
Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 1216, S.D. 1, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Condition the issuance of a certificate of inspection upon a vehicle or moped not being equipped with a noisy muffler or exhaust system;
(2) Require rules regarding safety check inspections to ensure that a vehicle or moped is not equipped with a noisy muffler or exhaust system;
(3) Suspend, revoke, or refuse renewal of a permit for an official inspection station for repeatedly violating any rule regarding inspecting a noisy muffler or exhaust system within a certain period;
(4) Clarify the types of mufflers that are prohibited, except for certain motorcycles and mopeds;
(5) Increase the maximum fine for motor vehicle owners that violate noisy muffler laws; and
(6) Include repairing or installing a noisy muffler or exhaust system as a prohibited practice for motor vehicle repair laws.
Your Committee on Conference finds that excessive noise pollution, particularly from loud mufflers on motor vehicles, impacts many communities throughout the State. Your Committee on Conference further finds that strengthening inspection requirements and enforcement measures will enhance public health, safety, and quality of life for all residents in the State.
Your Committee on Conference has
amended this measure by:
(1) Deleting
language that would have exempted motorcycles and mopeds from motor vehicle
muffler modification regulations if the motorcycle or moped did not exceed
United States Environmental Protection Agency regulations;
(2) Making
it effective upon its approval; and
(3) Making
technical, nonsubstantive amendments for the purposes of clarity and
consistency.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 1216, S.D. 1, H.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 1216, S.D. 1, H.D. 2, C.D. 1.
