Madame:
Your Committee on Finance, to which was referred S.B. No. 1117, S.D. 2, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"
begs leave to report as follows:
The purpose of this measure is to:
(1) Prohibit a person from operating a moped or electric motorcycle in certain areas designated for bicycles;
(2) Rename the Electric Bicycle and Electric Moped Rebate Program as the Electric Mobility Device Rebate Program and amend the program by expanding eligibility requirements and maximum rebate amounts, shortening the time within which to claim a rebate, and offering an additional assistance rebate for certain students in financial need;
(3) Exempt certain class 3 electric bicycles from registration requirements;
(4) Establish a cap for the Electric Mobility Device Subaccount, which is used to fund the Electric Mobility Rebate Program, and requirements for transferring funds into the Subaccount;
(5) Amend age requirements for required helmet use while operating a bicycle or electric foot scooter, operation of a class 3 electric bicycle, and operation of an electric motorcycle or motor-driven cycle;
(6) Prohibit certain acts during electric bicycle operation and allow use of electric bicycles on public sidewalks under certain conditions; and
(7) Appropriate funds for the Electric Mobility Rebate Program.
Your Committee received testimony in support of this measure from the Office of Climate Change, Sustainability and Resiliency of the City and County of Honolulu; Keiki Injury Prevention Coalition; and Kapiʻolani Medical Center for Women & Children. Your Committee received comments on this measure from the Department of Transportation; Oahu Metropolitan Planning Organization; Hawaiʻi Appleseed Center for Law & Economic Justice; Ulupono Initiative; and PeopleForBikes.
Your Committee has amended this measure by:
(1) Changing the cap on the total amount of rebates that the Department of Transportation may issue within a fiscal year to an unspecified amount;
(2) Changing the Electric Mobility Device Subaccount balance cap to an unspecified amount;
(3) Changing the effective date to July 1, 3000, to encourage further discussion; and
(4) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1117, S.D. 2, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 1117, S.D. 2, H.D. 2.
