Sir:

 

     Your Committees on Transportation and Culture and the Arts and Energy and Intergovernmental Affairs, to which was referred S.B. No. 1008 entitled:

 

"A BILL FOR AN ACT RELATING TO PARKING,"

 

beg leave to report as follows:

 

     The purpose and intent of this measure is to authorize the counties to adopt ordinances to enforce the accessible parking space requirements for parking spaces reserved for persons with disabilities and electric vehicles.

 

     Your Committees received testimony in support of this measure from the Disability and Communication Access Board, one member of the County of Maui, and four individuals.

 

     Your Committees received comments on this measure from two individuals.

 

     Your Committees find that the Disability and Communication Access Board, which administers the statewide program on parking for persons with disabilities, has received numerous complaints about places of public accommodation failing to comply with federal and state requirements for providing parking spaces reserved for persons with disabilities.  This problem is largely because no authority has been designated to enforce and collect the legally established penalties for noncompliance.  This measure resolves ambiguity regarding enforcement by authorizing the counties to adopt ordinances to enforce compliance with existing requirements.

 

     As affirmed by the records of votes of the members of your Committees on Transportation and Culture and the Arts and Energy and Intergovernmental Affairs that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 1008 and recommend that it pass Second Reading and be referred to your Committee on Judiciary.
