Madame:

 

     Your Committee on Transportation, to which was referred S.B. No. 1008 entitled:

 

"A BILL FOR AN ACT RELATING TO PARKING,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Repeal the requirement that a public or private entity that provides a parking space for persons with disabilities comply with laws governing parking for disabled persons, including any penalties; and

 

     (2)  Authorize each county to adopt ordinances to enforce the accessible parking space requirements for parking spaces reserved for persons with disabilities and electric vehicles.

 

     Your Committee received testimony in support of this measure from one member of the Maui County Council; Climate Protectors Hawaii; Kauai Climate Action Coalition; and four individuals.  Your Committee received testimony in opposition to this measure from the Retail Merchants of Hawaii.

 

     Your Committee finds that the improper use and lack of enforcement of parking spaces reserved for persons with disabilities hinders access for individuals who rely on these spaces for mobility and independence.  Similarly, the unauthorized use of electric vehicle charging spaces by non-electric vehicles disrupts transportation for electric vehicle users and undermines the State's efforts to promote sustainable transportation.  This measure empowers counties to adopt ordinances enforcing accessibility and electric vehicle parking requirements, ensuring compliance with established standards and maintaining unimpeded access for program participants.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1008, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1008, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
