Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 990, H.D. 2, S.D. 1, entitled:

 

"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to satisfy several claims against the State, its officers, or its employees.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Appropriating:

 

          (A)  $69,113.33 in general funds for a claim by Gilbert Collins;

 

          (B)  $166,492.00 in general funds for a claim by National Commerce Bank Service;

 

          (C)  $50,210.67 in general funds for a claim by Olinda Country Estates, Inc.;

 

          (D)  $22,674.17 in general funds for a claim by Sofia Lerman Estate;

 

          (E)  $100,000.00 in general funds for a settlement in the case of Donna Opulento v. State of Hawaii Department of Public Safety;

 

          (F)  $100,000.00 in general funds for a settlement in the case of D.O. v. State of Hawaii, Department of Education;

 

          (G)  $140,000.00 in general funds for a settlement in the case of Leonard Ramboyon v. Esther Kanehailua;

 

          (H)  $50,000.00 in general funds for a settlement in the case of Jon R. Chung v. State of Hawaii;

 

          (I)  $298,000.00 in general funds for a settlement in the tort claim by Kamaka Air, LLC;

 

          (J)  $512,700.83 in general funds for a judgment in the case of John Roe No. 121 v. State of Hawaii;

 

          (K)  $115,000.00 in general funds for a settlement in the case of Anela Aplaca v. State of Hawaii;

 

          (L)  $125,000.00 in general funds for a settlement in the case of Stacy J. Bruhn v. State of Hawaii;

 

          (M)  $26,771.00 in general funds for a judgment in the case of Healoha Carmichael v. Board of Land and Natural Resources;

 

          (N)  $18,000.00 in general funds for a settlement in the case of Kona Mike's Surf Adventures, LLC v. Dawn N.S. Chang; and

 

          (O)  $70,000.00 out of the state highway fund for a settlement in the case of Susanna Sigal v. State of Hawaii;

 

     (2)  Amending the amount and percentage of exceedance of the appropriations over the general fund expenditure ceiling for fiscal year 2024-2025;

 

     (3)  Changing the effective date to upon approval; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 990, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 990, H.D. 2, S.D. 1, C.D. 1.
