Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 892 entitled:

 

"A BILL FOR AN ACT RELATING TO GEOGRAPHICAL RESTRICTIONS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to establish limitations on geographical restrictions imposed as a condition of probation.

 

     Your Committee received testimony in support of this measure from the Judiciary and Office the Public Defender.

 

     Your Committee finds that the imposition of geographical restrictions as a condition of probation, the goal of which is rehabilitation, has significant effects on an individual's life.  Although imposing geographical restrictions is intended to promote accountability and public safety, it is not always an effective tool for probation because the size of the geographic area dilutes the enforceability of the condition and ultimately makes an individual's reintegration into society more challenging.  Your Committee believes that more narrowly tailoring geographic restrictions may be a better solution.

 

     Your Committee has amended this measure by:

 

     (1)  Limiting the area of a geographical restriction to no larger than 0.5 acres; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 892, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 892, H.D. 1, and be placed on the calendar for Third Reading.
